- Scope and Contenti) Humphry Fyshe, Ickwell, esquire Henry Fyshe Palmer, esquire, second son and heir apparent of said Humphry by Ann Stillingfleet, his late wife ii) Reverend James Stillingfleet, Dean of Worcester Reverend Richard Bentley, D.D., Master of Trinity College, Cambridge iii) Roger Coningesby, Lincoln’s Inn, Middlesex, esquire iv) John Heaton, Sherborne Lane, London, gentleman whereas: by marriage settlement of Humphry Fyshe and Ann Stillingfleet, his late wife, of 17 May 1695, a certain wood was limited to use of trustees for 100 years with remainder to ii) during natural lives of Humphry Fyshe and wife Ann in trust to preserve contingent remainders. Humphry Fyshe and wife Ann to take profits of said wood, and after decease of Humphry Fyshe and wife Ann then to their sons successively : first son is dead without issue male whereby inheritance of said wood is devolved upon Henry Fyshe Palmer expectant upon decease of Humphry Fyshe but the freehold during his life is remaining in ii) now to bar all estates tail and remainders in said wood and in consideration of 5s. a piece paid by iii) ii), by direction of i) have released to iii) - wood in Old Warden known as Parkewood (141 acres) to hold during natural life of Humphry Fyshe to intent that iii) may become tenant of the freehold in order that a common recovery may be had against him by iv) as demandant in which i) shall be severally vouched, which when said recovery is perfected shall be to use of Henry Fyshe Palmer and iii) and of heirs of said Henry, in trust for Henry and his heirs signatures Henry Fish [sic] Palmer ii) endorsed witnesses Thomas Drew Abel Sawyer Allen Wheeler Thomas Bentley, LL.D
