    Abstract of Title of Norman Knowles Spencer to hereditaments on Aspley Heath ALL HEREDITAMENTS (I) Conveyance of 23 June 1895 Parties: (1) Theed William Pearse; (2) Robert Sim Eveleigh Operative Part: - (1) conveyed (a) to (2) for £390 Property shown on a plan included on the original deed PART OF THE HEREDITAMENTS (II) R6/3/9/1 (III) R6/3/9/3 (IV) R6/3/9/6 THE REMAINDER OF THE HEREDITAMENTS (V) Conveyance of 2 April 1889 (1) Robert Sim Eveleigh, formerly of Bedford, now of Aspley Heath, accountant; (2) James Ward Maxwell of Bedford, draper Operative Part: - (1) conveyed (a) to (2) for £100 Property [as shown on attached plan]: (a) land on Aspley Heath with a frontage to the road from Woburn Sands to Little Brickhill of 75 feet and a depth of 166 feet bounded: SW by land of Frederick Croxhall Boultbee; SE in part by land of Frederick Croxhall Boultbee and on the other part by a sand pit; NE by land formerly of Arthur Wellsley, then of James Ward Maxwell; NW by the road (VI) R6/3/9/2 (VII) R6/3/9/5 (VIII) R6/3/9/7 AS TO ALL THE HEREDITAMENTS (IX) Will of Thomas Spencer of Bedford, builder of 6 March 1890: - appointing his wife Emma, friend Edward Payne Rose of Bedford, draper and son Harry Tom Boden Spencer as executors and trustees; - appointing his wife for her life, then the trustees, to be guardians of his infant children; - bequeathing to his wife for her life a books, pictures, prints, plate, linen, china, household furniture and effects and pony carriage, after her death all these becoming residue of his estate; - devising and bequeathing to the trustees all real and personal estate in trust for sale of real estate and personal estate consisting of money investing the proceeds to pay his wife an annuity of £700 per annum to maintain the home and their children until their youngest child was 21 and to pay £20 per annum to his daughters who were over the age of 21; the remainder to collect interest; - as soon as the youngest child became 21, £6,000 to be invested to give an income for his wife’s absolute use or, if she agreed, giving her an annuity of £250 per annum instead; - after the death of his wife his estate to be divided equally amongst their children, when all were aged over 21, though Harry Tom Boden Spencer was to receive £500 less than the rest because the testator had conveyed property to him in his lifetime (X) codicil of 30 October 1890 to the will of Thomas Spencer stating that he had given his daughter Lydia Boden Rose £400 and so her share of the estate should be £400 less than her siblings other than Harry Tom Boden Spencer. (XI) codicil of 20 May 1895 to the will of Thomas Spencer stating that he had given his son Harry Tom Boden Spencer £300 and £800 to his son George Alexander Spencer, then of Alberni, Vancouver Island, British Columbia [Canada] so their eventual shares of the estate should be adjusted accordingly (XII) Death of Thomas Spencer at Saint Leonard’s-on-Sea [Sessex] on 21 March 1896 (XIII) Deed poll of 29 April 1896 by Edward Payne Rose renouncing trusteeship of the will of Thomas Spencer (XIV) Proof of the will and codicils of Thomas Spencer in Northampton DPR on 17 June 1896 (XV) Deed of Appointment Parties: (1) Emma Spencer; Harry Tom Boden Spencer; (2) Joshua Wigley Boden of 133 Finchley Road, London, estate agent; George Abel Wall of Elm Grove, Cricklewood [Middlesex], asphalt contractor; Thomas Edward Rose of Albany Street, Bedford, draper Operative Part: - (1) appointed (2) as additional trustees of the will of Thomas Spencer in the place of Edward Payne Rose (XVI) Deed of Arrangement: Parties: (1) Emma Spencer, Harry Tom Boden Spencer; Joshua Wigley Boden; George Abel Wall; Thomas Edward Rose; (2) Emma Spencer; (3) Harry Tom Boden Spencer; (4) Lydia Boden Rose, wife of Thomas Edward Rose; (5) George Alexander Spencer of Alberni, British Columbia, builder; (6) Percy Spencer of Bedford; (7) Maude Spencer of Bedford, spinster; (8) Sydney John Spencer of Bedford; (9) Norman Knowles Spencer of Bedford Reciting: - (2)-(8) had agreed the division of the estate of Thomas Spencer, as had (9) but he was then under 21 year of age Operative Part: - the execution of the deed was conditional on it also being executed by (9) when he became 21; - property in the first schedule should be retained by (1) upon trust to pay an annuity of £250 to (2); - the trustees could sell the property in the first schedule with the consent of (2) as long as they held £1,250 to invest and pay the £250 annuity; - any surplus income should be held on the same terms as the property in the first schedule; - if rents etc. from the property in the first schedule were insufficient to pay the £250 annuity the property should be mortgaged or sold to make up the difference; - the £250 annuity should be paid in quarterly instalments; - on the death of (2) the property in the first schedule should be held by (1) in trust for equal division amongst (3)-(9); - the property in the first part of the second schedule was to be conveyed and cash paid to (3), subject to mortgage and he would indemnify (1) against all claims in respect of the mortgage being given by (3) for £800 referred to in the second codicil of the will of Thomas Spencer; - property in the second part of the second schedule should be conveyed to (4), who was to give credit for the £400 referred to in the second codicil of the will of Thomas Spencer; - property in the third part of the second schedule was to be conveyed to (5) who should covenant to indemnify (1) against all claims in respect of mortgage credit given by (5) for £800 referred to in the second codicil to the will of Thomas Spencer and for £350 received from (1); - property in the fourth part of the second schedule was to be conveyed to and costs paid by (6); - property in the fifth part of the second schedule was to be conveyed to and costs paid by (7); - property in the sixth part of the second schedule was to be conveyed to and cost paid by (8) subject to a mortgage on part of it and (8) was to covenant to indemnify (1) against all claims in respect of the mortgage; - property in the seventh part of the second schedule was to be conveyed to and at the expense of (9) subject to the mortgage on it and (9) was to indemnify (1) against any claims in respect of the mortgage; - property in the third schedule was to be held by (1) on trust to realise it and divide the sum equally between (3) to (9) 1st Schedule - freehold house and garden known as 40 de Parys Avenue, Bedford; in the occupation of Mrs. Ash; valued at £1,200; rent £68 per annum; - freehold house ad garden known as 30 de Parys Avenue, Bedford, in the occupation of Mr. Fletcher; valued at £1,700; rent £96 per annum; - freehold house and garden known as 44 de Parys Avenue, Bedford; in the occupation of Mr. Wiseman; valued at £1,500; rent £90 per annum. 2nd Schedule Part 1 - freehold houses and gardens known as 5 and 7 Linden Road, Bedford; in the occupation of Mrs. Adams and Mr. Kinross; valued at £2,000; mortgaged for £1,200; - freehold house and garden known as Pinewood, Aspley Heath; in the occupation of G.
