    -- the plaintiffs are farmers of Higham and Ditchford Mills; citing: Letters patent, 29 May 1609. assigning the mills to Edward Ferrers and Francis Phillips at rent of £25.7s.4d. per annum Bargain and Sale 5 September 1609, Ferrers and Phillips to William Payne at same rent. Demise: by Payne to plaintiffs at same rent and they entered into bonds to keep the mills in repair. Plaintiffs complain that the inhabitants of Higham Ferrers and Rushden are obliged by ancient custom to grind their corn, grain and malt at these mills, and that it is not lawful to erect any other querns or mills or for millers to carry away corn etc. to grind. reciting: case of Richard Warner gentleman versus John and Thomas Dawes (1538/9, 1573/4) and Warner versus William Hughes 1577/8) Defendant, John Markham of Stanwick Mills is grinding the corn of the inhabitants of Higham and Rushden Plaintiffs request confirmation of former judgements and injunction versus Markham.
