- Scope and Contentreciting release of 14 January 1843 [Z450/4] and assignment of 24 June 1846 [Z450/8] reciting also will of William Harbett, dated 24 October 1846 -- to Alice Hunt, Alice Richardson and Charlt Vyse as tenants in common -- freehold messuage as firstly described in assignment of 24 June 1846 -- to said William Hunt on trust for sale -- freehold messuage at Toddington (as are secondly described) proceeds to be invested and interest paid to Franklin Harbett, Susan Ogden, Lucy Stokes, Harriett Harbett and Elizabeth Witherington for their lives and then fall into his personal estate -- to Rebecca Teedon -- freehold messuage or cottage in Ampthill Road, near Toddington, in the occupation of Joseph Bean -- freehold land in road leading from Toddington to Tebworth in his own occupation [said land etc. being thirdly described in above assignment] -- to William Hunt -- freehold messuage in Toddington etc. [also thirdly described] in trust to receive rents and to pay them to Caroline Cooper Cooper for life, and then to William and Alice Hunt jointly for their lives and then to Emily Waller, for ever -- to said Alice Hunt -- residue of estate, except legacy of £50 to Thomas Tomlinson charged upon lastly mentioned estates in case personal estate should prove insufficient for payment of same said William Hunt appointed executor William Harbett died in April 1847. Will proved by William Hunt Said William Harbett did not surrender copyhold land [ as provided in Z450/4] also part of lands thirdly described in assignment is not freehold but copyhold of Manor of Toddington After his death a dispute arose between William and Alice Hunt and some other persons claiming under his will as to validity of same indenture [Z450/4] and William Hunt remained in possession of rents and profits and as executor took possession of household furniture and coverted same into money, now in possession of Frederick Gough, the auctioneer. At Court Baron of Manor of Toddington held on 9 July 1847 said William Hunt in right of his wife was admitted to copyhold as in deed of 14 January 1843 and such property thirdly described in said deed as are of copyhold tenure. On 10 September 1847 said Rebecca Teedon, Franklin Harbett, Ann Barker, Susan Ogden, James Stokes and wife Lucy, Harriett Harbett, and said Thomas Attlee, an infant, the brother of said Harriett Hillyard Attlee (who had died intestate) filed a bill against said William Hunt and wife Alice, Joseph Richardson and wife Harriett, Richard Vyse and Charlt his wife, Elizabeth Witherington, Caroline Cooper Cooper, Emily Waller, Thomasa Tomlinson, Thomas Wright Richards, Edward Handscomb and N.G. Lambert and wife Mary Ann, as defendants. Various claims made against the will ‘and that the said will was altogether inoperative upon the Estates and properly comprised in the said Indenture of Settlement’, and that account might be taken of the household furniture, personal effects etc. Also that copyhold estates passed by said indenture of settlement or if not then same were liable to the payment of the debts of said William Harbett Said Rebecca Teedon died on 30 November 1847. By her will she appointed Blackall Joseph Yarrow and John Kitchener as executors but no devise was made of the real estate devised to her by William Harbett. Will proved (Prerogative Court of Canterbury) on 23 December 1847. Suit was revived by plaintiffs by filing a Bill of Revivor and Supplement against Richard Teedon and Blackall Joseph Yarrow. All parties being desirous of determining the dispute now it is agreed between Thomas Wright Richards, Edward Handscomb, Franklin Harbett , Ann Barker, Susan Ogden, Lucy Stokes, Harriett Harbett, Thomas Attlee , N.G. Lambert and wife Mary Ann, William Hunt and wife Alice, Joseph Richardson and wife Harriett, Richard Vyse and wife Charlt, Elizabeth Witherington, Caroline Cooper Cooper, Emily Waller and Thomas Tomlinson as follows: Bill to be dismissed as against all defendants claiming under the will of William Harbett except said William Hunt and wife Alice, with costs as specified said William Hunt and wife Alice, Joseph Richardson and wife Harriett, Richard Yyse and wife Charlt, Franklin Harbett, Susan Ogden, Lucy Stokes, Harriett Harbett, Elizabeth Witherington, Richard Teedon, Caroline Cooper Cooper and Emily Waller should release to Thomas Wright Richards according to their respective interests, the freehold property previously described Thomas Tomlinson should assign to Thomas Wright Richards the legacy of £50 William Hunt should assign to Thomas Wright Richards the household furniture and personal estate, and contained in the residue bequeathed to said Alice Hunt William Hunt and wife Alice should at the expense of Thomas Wright Richards surrender to him the copyhold property Frederick Gough should pay to Thomas Wright Richards the proceeds of the sale of the personal estate Thomas Wright Richards should thereupon pay £250 to William Hunt Thomas Wright Richards should pay the funeral expenses of William Harbett and all the debts still owing including debt of £1800 Now said Frederick Gough has paid proceeds of sale of personal estate to Thomas Wright Richards reciting also a deed of - - between (a) William Hunt and wife Alice (b) Joseph Richardson and wife Harriett (c) Richard Vyse and wife Charlt (d) said William Hunt (e) said Franklin Harbett , Susan Ogden , Lucy Stokes, Harriett Harbett , Elizabeth Witherington (f) Richard Teedon (g) Caroline Cooper Cooper (h) Emily Waller (j) Thomas Tomlinson (k) Thomas Wright Richards In consideration of said agreement and in consideration of said Bill being dismissed and of payment by Thomas Wright Richards to Joseph Richardson and wife Harriett, Richard Vyse and wife Charlt, Elizabeth Witherington, Richard Teedon, Caroline Cooper Cooper, Emily Waller and Thomas Tomlinson, of their respective costs, and of payment by Thomas Wright Richards to William Hunt and wife Alice of their costs of the said suit as between solicitor and client and of further sum of £210 paid by Thomas Wright Richards to William Hunt and wife Alice, Joseph Richardson and wife Harriett, Richard Vyse and wife Charlt, said William Hunt, Franklin Harbett, Susan Ogden, Lucy Stokes, Harriett Harbett, Elizabeth Witherington, Richard Teedon, Caroline Cooper Cooper, and Emily Waller according to their respective interest in the premises William Hunt and wife Alice to Thomas Tomlinson released and confirmed to Thomas Wright Richards -- all lands referred to -- freehold messuages devised by said will of William Harbett, deceased to hold free of all trusts in the will of William Harbett, to use of Thomas Wright Richards for ever Thomas Tomlinson assigned to Thomas Wright Richards -- said legacy of £50 William Hunt assigned to Thomas Wright Richards -- household furniture, personal estate etc. of said William Harbett also in consideration of £40 paid by Thomas Wright Richards to William Hunt and wife Alice, William Hunt covenanted with Thomas Wright Richards that they William Hunt and wife Alice, would, at the cost of Thomas Wright Richards, surrender into hands of Lord of Manor of Toddington -- copyhold property of late William Harbett to the use of Thomas Wright Richards now Thomas Wright Richards, Edward Handscomb, Franklin Harbett, John Barker, Susan Ogden, James Stokes, Harriett Harbett, Thomas Attlee, Nathaniel Grace Lambert, Elizabeth Witherington, Caroline Cooper Cooper, Richard Teedon and Thomas Tomlinson do acquit and exonerate William Hunt from all the freehold and copyhold premises comprised in indenture of settlement and devised by the will of William Harbett, all rents, monies, actions, suits, accounts etc.which they may have against William Hunt etc. Thomas Wright Richards covenants to pay the funeral expenses of William Harbett and all debts unpaid at his death (including mortgage debt of £1800) copy signatures of Thomas Wright Richards, Edward Handscomb, Franklin Harbett, John Barker, Susan Ogden, James Stokes, Harriett Harbett, Thomas Attlee, Nathaniel Grace Lambert, Elizabeth Witherington, Caroline Cooper Cooper, Richard Teedon and Thomas Tomlinson Witnesses: (copy): Henry Lamb, George W.
