    Covenant to Surrender copyhold hereditaments and Declaration of Trust Parties: (i) Wyndham Edward Hanmer of Ampthill, esquire and Victoria Maria Louisa, his wife; (ii) Henry Hanmer of Stockgrove [Buckinghamshire], colonel; (iii) Sir John Hanmer of Hanmer [Flintshire], baronet; Richard Baker Wingfield of 2 Loundes Square [Middlesex], esquire Reciting: - Sir John Conroy, bart., deceased (father of V. M. L. Hanmer) agreed to put £6,000 in settlement at his death for their benefit and, not having done so, Wyndham Edward Hanmer recently received £6,000 in fulfilment of the agreement; - Wyndham Edward Hanmer was seised of (a) and on which he had recently expended a large sum on improving the cottage and was also entitled to £5,000 he had lent to his uncle, (ii), at 4% interest and had determined on making a settlement of the land and the £5,000 as an equivalent of the £6,000 received from Sir John Conroy and it was agreed with the Conroy family that (ii) should give his bond to (iii) for securing payment of the £5,000 after his death with interest at 4%; - (ii) had executed his bond of obligation to (iii) in the penal sum of £10,000 with provision for making it void on repayment of the £5,000 and interest Operative Part: - (i) covenanted with (iii) to surrender (a) to them Property: (a) dwelling house with outbuildings and all inclosed land, formerly three pieces now laid together with the house and comprising 13 acres, 2 roods, 29 poles at Copt Hill, Heath and Reach bounded: N and W by lands of Saint George’s Chapel, Windsor and Henry Hanmer as their lessee, E by lands of John Mortimer, Thomas Swinstead and William Manning, S by the Linslade road Operative Part: - (iii) covenanted to call in the £5,000 as soon as it was payable [i.e. on the death of Henry Hanmer] and, with the consent in writing of (i), invest the money Agreement that (iii) stand possessed in trust to pay an annuity from the invested money to Wyndham Edward Hanmer for life, remainder to Victoria Maria Louisa Hanmer for life and, after the death of the survivor stand possessed of the £5,000 and (a) in trust for the children of (i) Proviso for enfranchisement of (a) Proviso for Victoria Maria Louisa Hanmer to occupy (a) after the death of Wyndham Edward Hanmer Proviso for (iii) to sell (a) with the consent of (i) Proviso for the purchase of further land with the £5,000 at the direction of (i) Proviso allowing leases of (a) or other land Proviso to appoint fresh trustees Witnesses: - John Adolphus Young of Saint Mildred’s Court, Poultry, London, solicitor; - John Bridges of Red Lion Square, solicitor Indorsed with Indenture of 17 August 1868 Parties: (i) Wyndham Edward Hanmer and Edward John Henry Hanmer of Rushmere Lodge, his son; (ii) Sir John Hanmer and Richard Baker Wingfield, now called Richard Baker Wingfield Baker Reciting: - death of Victoria Maria Louise Hanmer on 9 February 1866; - no appointment of the £5,000 had been made; - Edward John Henry Hanmer was the only child of the marriage, had attained twenty one years and was absolutely entitled to the sum of £5,000; - death of Henry Hanmer on 5 February 1868; - (ii) had received £5,000 from the trustees of the will of Henry Hanmer and it was agreed that it should be paid by (ii) to (i) Operative Part: - (ii) paid £5,000 to (i); - (i) released (ii) from any further action Witness: - Charles Edward Jones of 2 Saint Mildred’s Court, London
