(i) John Orlebar of Tunbridge Wells,Kent Captain in Royal Navy (ii) Richard Longuet Orlebar of Hinwick House, as surviving trustee of settlement of 5 February 1838 [see V327] (iii) said Richard Longuet Orlebar, Reverend Frederick William Hanham Layton of Islington, Middlesex clerk, William Wowen Rooke of Woodside near Lymington, Hampshire, Ellis Watkin Cunliffe of Bordeaux in the Empire of France and Fenchurch Street London, merchant, as trustees of settlement of 23 August 1839 (iv) Edward Carey late of Bexley Terrace, Greenwich, Kent. (v) said Richard Longuet Orlebar, John Orlebar, William Thomas Longbourne of Grays Inn, Middlesex as trustees of settlement of 16 September 1831 (vi) said Frederick William Hanham Layton and wife Maria Caroline (vii) said Richard Longuet Orlebar, Miles Charles Seton of Southampton Row, Edgeware Road Middlesex as surviving trustees of settlement of 2 January 1836. (viii) said Richard Longuet Orlebar as administrator of personal estate of Eliza Hannah Orlebar deceased (ix) William Augustus Orlebar of Hinwick House. recites: V322 and Indenture endorsed on it. whereas: there were eleven children of the marriage of Richard and Maria Orlebar four died unmarried under 21 years. Seven others lived to 21 years. John Cuthbert Diana Maria Caroline (now wife of Frederick William Hanham Layton) Eliza Hannah Madeline Augusta recites: Marriage Settlement 16 September 1831 (i) Edward Carey (ii) Roger Wood and wife Constantia (iii) said Richard Orlebar (iv) said Diana Orlebar (v) said William Augustus Orlebar, Roger Wood, Richard Longuet Orlebar reciting: that Diana Orlebar was under the marriage settlement of her parents entitled to certain monies; these to be vested in William Augustus Orlebar, Roger Wood and Richard Longuet Orlebar who were to lay the money out as therein mentioned on trust that the survivor of Edward Carey and Diana Orlebar should receive the income of the same whereas: said Richard Orlebar died 20 January 1833; Maria survived him recites: Deed Poll 2 January 1836 by said Maria Orlebar appoints one-sixth of £5,974.3s.4d. 3% consolidated annuity and £185.15s. per annum long annuity to Maria Cuthbert Layton (then Orlebar) to be paid on the death of Maria Orlebar. recites: Marriage Settlement 2 January 1836 (i) Frederick William Hanham Layton (ii) said Maria Orlebar (iii) said Maria Caroline Layton (then Orlebar) minor (iv) Richard Longuet Orlebar, John Newberry, Miles Charles Seton marriage of Frederick William Hanham Layton and Maria Caroline Layton. Frederick William Hanham Layton will assign to Richard Longuet Orlebar, Jon Newberry and Miles Charles Seton after the marriage the estate to which Maria Caroline Layton is entitled by above recited Deed Poll. Richard Longuet Orlebar, John Newberry and Miles Charles Seton would retain out of estate £1,000 and transfer rest to Frederick William Hanham Layton to pay annual income to Maria Caroline Layton and then to survivor and then to benefit of issue. whereas: said John Newberry is since deceased recites: marriage settlement [recited in V327] also recites V327 whereas: Edward Hale is since deceased recites: Deed Poll 2 July 1839 by Maria Orlebar appoints to John Orlebar and Cuthbert Orlebar 2 equal one-sixth shares in the said £5,974.3s.4d. 3% consolidated annuity £185.15s long annuity to be conveyed after the death of the said Maria Orlebar recites: Post-Nuptial Settlement 23 August 1839 (i) Cuthbert Orlebar and wife Eleanor (née Kingston) (ii) Richard Longuet Orlebar , Frederick William Hanham Layton , William Wowen Rooke, Ellis Watkin Cunliffe (therein by mistake called E. Wynn C.) reciting that Cuthbert Orlebar and wife Eleanor (née Kingston) were married 31 March 1838 without settlement. Cuthbert Orlebar assigns to (ii) his one-sixth share (as above); he is to receive income for life, then to survivor and then to benefit of their issue. whereas: said Cuthbert Orlebar died 1 August 1861 leaving wife and children recites: Marriage Contract made in French at Paris 21 October 1839 Albert Louis Francois Joseph Mirleau de Neuville, Viscount de Belle Isle and Madelina Augusta Orlebar Maria Orlebar settled on her daughter a dowry of 35,000 francs payable on decease of Maria Orlebar whereas: said Nicholas Isaac Hill and William Augustus Orlebar have sold the £185.15s. long annuity and invested produce in purchase of £2,684.14s. 3% reduced annuity Nicholas Isaac Hill is since deceased Diana Carey died 1862; Edward Carey survived her. Eliza Hannah Orlebar married in 1839 Arthur Bedford Orlebar and she died 4 October 1856; he survived and now resides at Melbourne, Australia and no settlement was made of her share (or his share in her right) in the trust funds settlement by V322. Administration for estate of Eliza Hannah Orlebar granted 5 January 1864 by Principal Registry to Richard Longuet Orlebar as attorney of Arthur Bedford Orlebar. Madelina Augusta Viscountess de Belle Isle died 1852 leaving Count de Belle Isle surviving Maria Orlebar married in 1845 Reverend John Vere Alston clerk and died 3 April 1863 recites: Indenture 8 February 1864 endorsed on settlement of 16 September 1831 (i) Edward Carey (ii) William Augustus Orlebar, Roger Wood, Richard Longuet Orlebar (iii) John Orlebar , William Thomas Longbourne reciting that at the death of Maria Alston the trust funds subject to her marriage settlement with Richard Orlebar consisted of £5,974.3s.4d. 3% consolidated annuity and £2,684.14s.0d. 3% reduced annuity in names of Nicholas Isaac Hill and William Augustus Orlebar and that Diana Carey (or Edward Carey in her right) had become entitled to one-sixth share of the funds William Augustus Orlebar and Roger Wood wish to be discharged from the trust of the settlement of 16 September 1831 so Edward Carey appoints John Orlebar and William Thomas Longbourne as trustees in their place jointly with Richard Longuet Orlebar whereas: William Augustus Orlebar as surviving trustee of V322 on 15 July 1863 sold £284.14s. 3% reduced annuity (part of the said £2,684.14s. like annuity) produced £264.8s.3d.; paid succession duty of £82.6s.6d. due on death of Maria Orlebar payable in respect of said £5,973.3s.4d. 3% consolidated annuity £2,684.14s. 3% reduced annuity balance of £182.1s.9d.retained for expenses William Augustus Orlebar as surviving trustee of V322 at request of John Orlebar transferred £995.13s.10d. 3% reduced annuity being one-sixth share of John Orlebar in £5,973.3s.4d. 3% reduced annuity also £400 3% reduced annuity one-sixth of the £2,400 like annuity into name of Richard Longuet Orlebar as surviving trustee of settlement of 5 February 1838 William Augustus Orlebar as surviving trustee of settlement of 23 August 1839 has transferred £995.13s.10d. 3% consolidated annuity being one-sixth late of Cuthbert Orlebar in the £5,974.3s.4d. like annuity also £400 3% reduced annuity one-sixth of £2,400 like annuity into names of Richard Longuet Orlebar, Frederick William Hanham Layton, William Wowen Rooke and Ellis Watkin Cunliffe as trustees of settlement of 23 August 1839 William Augustus Orlebar as surviving trustee of V322 at request of Edward Carey has transferred £995.13s.10d 3% consolidated annuity share of Diana Carey in the £5,974.3s.4d. like annuity also £400 3% reduced annuity one-sixth of £2,400 like annuity into names of Richard Longuet Orlebar, John Orlebar and William Thomas Longbourne as trustees of settlement of 16 September 1831 William Augustus Orlebar as surviving trustee of V322 at request of Frederick William Hanham Layton and wife Maria Caroline transferred £995.13s.10d. 3% consolidated annuity and £400 3% reduced annuity one-sixth of £2,400 like annuity into names of Richard Longuet Orlebar and Miles Charles Seton as surviving trustees of settlement of 2 January 1836 William Augustus Orlebar as surviving trustee of V322 at request of Richard Longuet Orlebar (as administrator aforesaid) sold out £995.13s.10d 3% consolidated annuity (being one-sixth share of Eliza Hannah Orlebar and now of said Arthur Bedford Orlebar in her right in said £5,974.3s.4d. like annuity) and has sold out £400 3% reduced annuity one-sixth of £2,400 like annuity and has paid produce of £903..11..10 £362..10.. 0 £1266.. 1 ..10 total (less £1.15s. for brokerage) to Richard Longuet Orlebar as administrator aforesaid now: John Orlebar, Edward Carey, Frederick William Hanham Layton, Richard Longuet Orlebar release William Augustus Orlebar from actions etc. in respect of their claims.
