    Recites Letters Patent; and grant by James, Duke of York of the three counties on Delaware. “William Penn . . . .during his life . . . . did go over to and take upon himself the charge of governing the said province and counties”, the last time being in 1701; William Penn died in 1718; province and powers of government now belong to John, Thomas and Richard; since they have not been able to go to Pennsylvania, the government has been carried out by a Lieutenant Governor, the present one being Patrick Gordon esquire, and their affairs “have greatly suffered by so long an absence of the Proprietors and do very much call for and require the presence of them”, etc. Therefore they agree to vest the government in the eldest who shall be in America.
