    i) Charles Samuel Lindsell, Biggleswade, Esq Henry Chaundler, Biggleswade, solicitor ii) Edward Tylee, The Chantry, near Frome, Somerset, Esq reciting mortgage of 22 October 1873 a) Rev James George Curry Fussell b) John Harvey Rev John Pardoe a) granted to b) - Baynton's Farm. Whatley, Somerset (as in schedule) - freehold - leasehold portions --- toft where messuage formerly stood in Rudge in Whatley formerly part of a tenement of John Gunning and demised to Elizabeth Baynton, widow, for term of 1000 years by deed of 4 May 1785 --- 11 lugs of ground whereon a cottage formerly stood in Home Mead (as devised to John Baynton for term of 1000 years by deed of 16 Mar 1790) to secure repayment of £2500 and interest John Pardoe died on 7 January 1879 and John Harvey on 7 April 1879 having appointed his wife, Anne Jane Harvey and John Harvey Astell as his executors. All estates vested in him as mortgagee devised to Charles Morris Roupell and Henry Godfrey Astell. Henry Godfrey Astell later denounced all estate bequeathed to him by said will reciting deed of 1 April 1881 1) Anne Jane Harvey John Henry Astell 2) Charles Morris Roupell 3) Harr Pardoe 4) Edward Allix Pardoe said mortgage debt of £2500 was still owing but same belonged in equity to 3) and 4) on a joint account. 1) and 2) assigned said sum of £2500 to 3) and 4), also Charles Morris Roupell conveyed all messuages, lands etc conveyed to use of 3) and 4). No reference made to assignment of the leasehold portions of the property. Harr Pardoe died on 11 July 1895 reciting deed of 26 July 1898 A) Edward Allix Pardoe B) John Henry Shore C) Sir John Lintorn Arabin Simmons, G C B John Henry Clarke Joseph Cooke Hurle A) assigned Baynton's Farm to use of C) in trust to sell premises at request of B) during his life Said property comprised all the property comprised in the mortgage except for certain small portions Sir John Lintorn Arabin Simmons died on 14 February 1903 reciting deed of - 1907 I) John Henry Clarke John Cooke Hurle II) John Henry Shore III) Jane Roeckel IV) Edward Tylee I) at request of II) conveyed to use of IV) - pieces pasture ground with yards and 2 cattle shed in Whatley, part of Baynton's Farm adjoining school premises in occupation Miss Fussell and abutting on road from Chantry to Frome (29.1.4). It is apprenhended that said portions of the property as were leasehold were not legally assigned by deed of 1 April 1881 and still remain vested in personal reps of John Harvey, deceased. now i) as personal res of Anne Jane Harvey assign to ii) - such parts of premises as are comprised in terms of 1000 years and 1000 years to hold to ii) for residue of said terms with schedule no signatures or witnesses
