Reciting a Conveyance dated 9 September 1955 between the Mayor and Corporation of Luton and 1) and 2) and concerning property acquired for the site of St. Francis, Vauxhall Park. 1) and 2) agree the land to be conveyed to 4) for an estate in fee simple in possession free from incumbrances but subject to the following conditions: a)In pursuance of the said agreement 1) as trustees at the request of 2) conveys to 4) all the land found on the plan, together with the right to use the drains or sewers land under the adjoining land to hold the same unto 4) in fee simple for the purpose of the site of the intended new church of St. Francis free from the trusts contained in the conveyance. b)at the request of 2), 1) assigns unto 4) in title the benefit of the covenant and the part of the Mayor and Corporation contained in clause (c) re to the property conveyed c)3) covenants by way of indemnity only with 1) and and a separate covenant with 4) that at all times observes the restrictions and stipulations in the said conveyance as far as they are still applicable to the property hereby conveyed and indemnify 1) and 4) from and against all proceedings, costs, claims and expenses d)2) covenant with 4) that they will rectify 4) from and against all proceedings, costs, charges and damages in respect of the church buildings e)1) acknowledges the rights of 4) to the production of the conveyance and to deliver copies With plan of site Signed by all parties
