  • Scope and Content
Reciting: will as in P61/2/24 but slightly more detailed : Bill of complaint of 22 Jan. 1867 between Jos. Bonomi and other creditors of Jn. Lee, and H.W. Buxton, Wm. Rutter, Thos. Chapman, Robt. Wilkinson and Rev. Chas. Lowndes. Bonomi is owed £80. 12s as architect for work and labour and several others are owed - 'considerable sums of money'. Buxton and others (the defendants) allege that the personal estate not specifically bequeathed is insufficient to pay them. Bonomi etc. (the plaintiffs) want the advowsons and other real estate to be sold to pay the debts etc. and seek a direction of the Court accordingly : decree of the Master of the Rolls made in the same suit on 26 Jan. 1867. Account and enquiry ordered and personal estate not specifically bequeathed be applied in payment of his debts and then in payment of the legacies and annuities without prejudice as to whether the charitable legacies are valid. All real estate in trust for sale to be sold. : Amended bill of complaint of 3 April 1867. Lowndes and others plaintiffs, L.C. Lee and Edw. D. Lee - defendants . Defandants pray that the will and codicils may be established and the trusts carried into execution and the rights of all interested persons be ascertained. Louisa Cath. Lee claims that by reason of certain actions, Edw. D. Lee's right to the furniture etc. has determined and that she is entitled to them. : Answer of L. C. Lee of 5 April 1867. She believes that testators personal estate at his death was more than sufficient to pay his debts, legacies etc. and that exors. took possession of personal estate specifically bequeathed to her, or Edw. D. Lee with their permission took possession of the items bequeathed to him. Also E.D. Lee conveyed, in the lifetime of the testator - on 19 March 1864 - to Hen. Ray Freshfield, the settled estate of Hartwell to use of E.D. Lee. This estate mortgaged by E.D. Lee, during lifetime of testator. On 28 July 1866 estate conveyed from Lee to Freshfield freed from entail etc. of E.D. Lee, to use of E.D. Lee. Mortgage still existed. So E.D Lee's right under testator's will to the furniture etc. ceased and L.C. Lee claims it. : Decree of 6 Nov. 1867 by Master of the Rolls. Various enquiries and accounts ordered. Also the testator's estate not specifically bequeathed be applied of his debts, legacies etc. Also to enquire what societies were intended by the descriptions given in the will. : Certificate of 30 June 1868 entitled 'Inthe Said Causes Bonomi v. Buxton and Lowndes v. Lee'. Freehold estates of Jn. Lee had been sold to various purchasers and some bought by E.D. Lee. Total received c. £8,600. (Lot 4 - Wymington Rectory - Rev. W. Monk - £1000.) With note of Jn. Sheffield, of Lincoln's Inn, 7 Aug. 1868 with questions on the glebe and whether Jn. Lee made a settlement on his marriage which affected the Wymington advowson. 'Subject to the above ... I think a title is clear..'
