The last time I paid Mr.How the rent I said to him I am going to leave at March I suppose you will not require a formal notice he said no & never gave a formal notice but I never considered I was tenant after March 1865. As I expended £15.0.0 in building a lobby in the place & £7.0.0 in other improvements I think it would be rather hard to expect me to pay the whole rent for which I may be liable normally £15.0.0. As the question of my liability is doubtful I think that the justice of the case wd be met by my paying £7:10 as I have not occupied the premises or used them in any way & never expected to be called upon for the rent". Copy reply from Thomas Sworder, Hertford: 20 Nov 1866 "Your letter is not explicit eno' to enable me to judge for I know little or nothing about the matter, as Mr.How is my Agent for the purpose of collecting my Rents. Up to what time did you pay Rent & how much was it per Ann? for I really do not know. I can only say that the Old Brewery has been (as you must be aware) a very losing concern for me & that I cannot afford to give up any claim that I have. And unless you legally determined your Tenancy I must request you to pay the Rent. I understood from Mr.How that you not only had not paid the Rent, but had kept the keys so that it could not be let again - if so, you must pay, for you as a Lawyer must know that unless due notice was given & possession given, you remain Tenant & are liable to pay the Rent. And I really cannot afford to lose a year's rent because you do not choose to take ordinary precaution to put an end to your Tenancy.If you will pay all rent up to Xmas next I will release you continued from any further claim".
