Draft reassignment and release: Parties: (i) William Anstee of The Tythe Farm, Chalton, esquire; Benjamin Bennett of Cheverells Park, Dunstable, esquire; (ii) William Anstee, Benjamin Bennett and John Kinder of Church House, Harlington [Middlesex] esquire; (iii) Benjamin Bennett; (iv) William Anstee; (v) William Tait of 4 Holwood Road, Bromley [Kent]; Adam Tait of Well Walk, Hampstead [Middlesex], gentleman; (vi) John Cook late of Lower Townsend Farm, Houghton Regis, farmer; William Tait; (vii) Thomas Sworder of Luton, brewer Reciting: - mortgage of 1 Apr 1855 from (vii) to John Anstee [X95/267] for £500 already owing and an additional £1,450 secured on Eagle, Dunstable and other cottages; - X95/235; - mortgage of 10 May 1864 [X95/268] from (vii) to (i) and John Cook for £1,000 secured on Rose & Crown, Woburn and Green Man, Chalk Hill, Houghton Regis; - mortgage of 18 Jul 1864 from Charles Lawford of Luton, builder to John Anstee for £500 secured on Melson Arms, corner of Hitchin Road and John Street, Luton; - mortgage of 19 Feb 1867 [X95/269] from (vii) to (i) and John Cook for £500 secured on Antelope, Albert Road, Luton; - conveyance of 11 Jun 1879 from Charles Lawford to (vii) of Melson Arms subject to mortgage to John Anstee; - all mortgages above had been for the purposes of the business of Thomas Sworder & Company; - by 29 Jan 1878 a total of £12,500 was owing to (i) and John Cook being £3,500 to William Anstee, £5,000 to John Cook and £4,000 to Benjamin Bennett; - agreement of 29 Jan 1878 in which (i) advanced £8,000 each to (vii) on security of the Park Street brewery with its licensed premises in Bedfordshire and Hertfordshire charged with total repayment to William Anstee of £11,500 and Benjamin Bennett of £12,000; - X95/240; - death of Benjamin Bennett the elder on 8 Dec 1882 intestate; - will of John Anstee of 20 Apr 1869 devising all hereditaments vested in him by way of mortgage etc. to (ii); - death of John Anstee on 14 Aug 1870 and proof of his will on 21 Jan 1871 in PPR; - in Feb 1880 (vii), with agreement of (i), sold some premises to Edwin Ransom paying the £1,000 purchase money to (i); - mortgage of 11 Mar 1880 in which (vii) borrowed £1,000 from (i) on security of Cross Keys, George Street, Luton; - X95/243; - will of John Cook of 3 Nov 1883 appointing his son John, his brother Thomas Daniel and his son-in-law William Tait executors and bequeathing £5,000 and other money invested in Thomas Sworder & Company to his daughter Martha Elizabeth Tait; - death of John Cook on 2 May 1884 and proof of his will in Northampton DPR on 10 Oct 1884; - will of Martha Elizabeth Tait of 27 Mar 1885 bequeathing her personal estate to (v) upon trusts; - death of Martha Elizabeth Tait on 8 Mar 1889 and proof of her will on 27 Apr 1889 in PPR; - X95/244; - £1,950 had still been owing to (ii); - £500 had still been owing to (iv); - £11,000 had still been owing to (iv); - £5,000 had still been owing to (v); - £12,500 had still been owing to (iii); - £1,000 had still been owing to (i); - before this deed (vii) had paid all these sums to (i)-(v) Operative Part: - (i), with assent of (ii), (v) and (vi) surrendered Thomas Sworder & Company to (vii) with all buildings, trade, plant etc.
