    Copy Agreement: Parties: (i) Thomas Sworder of Luton, brewer; (ii) William Anstee of The Tythe, Chalton, esquire; John Cook of Bramingham, esquire; Benjamin Bennett the younger of Dunstable, brewer Reciting: - X95/235; - to enable (ii) to carry on the business (i) executed leases described in first schedule below; - after expiration of terms (ii) remained holding properties in second schedule below by virtue of memorandum of agreement ; - properties in second schedule had become vested in (i) but were held by (ii) under memorandum of agreement; - (ii) were owed £12,500 of which £3,500 was due to William Anstee, £5,000 to John Cook and £4,000 to Benjamin Bennett the younger; - William Anstee and Benjamin Bennett the younger had, that day, advanced £8,000 each to (i) secured by a mortgage agreement subject to redemption on payment to William Anstee of £11,500 and to Benjamin Bennett of £12,000; - to enable (ii) to carry on the business (i) agreed to enter into this agreement Operative Part: - (i) would, when required by (ii), grant to them leases of brewery and other premises in the leases in the first schedule below, (except properties in third schedule below) and of all property in second schedule below for 21 years from 1 Oct 1877 at £2,100 per annum rent; - the lease would contain all covenants, provisos and agreements in leases in first schedule; - the lease would contain power for (i) to determine it on giving six months' notice; - the lease would contain power for (ii) to determine it giving six months notice; - if (ii) required it, (i) would make all arrangements to confirm and extend powers contained in X95/235; - on repayment of all debts William Anstee and Benjamin Bennett would release the premises to (i); - if (i) gave notice of his intention to take back the business or (ii) gave notice of winding it up (ii) would continue to hold the lease in the meantime First Schedule: - lease of 1 Oct 1862 from (1) Henry Vyse of 76 Wood Street, City of London, esquire; Thomas Foster of Luton, gentleman, Edmund Waller Vyse of Luton, gentleman, Thomas Sworder of Hertford and Thomas Sworder of Luton to (2) William Anstee of The Tythe, Chalton, esquire; John Cook of Bramingham, esquire; Benjamin Bennett the younger of Dunstable, brewer for 10 years from 29 Sep 1862 at £350 per annum rent; - lease of 1 Oct 1862 from (1) Thomas Sworder of Luton to (2) William Anstee of The Tythe, Chalton, esquire; John Cook of Bramingham, esquire; Benjamin Bennett the younger of Dunstable, brewer for 10 years from 29 Sep 1862 at £427/10/- per annum rent Second Schedule: - brewery, with adjoining dwellinghouse in occupation of Whitlock, with stables, storehouses, malthouses etc. belonging in Park Street, Luton bounded at rear by parish churchyard; - Borough Arms, corner of Albion Road and Edward Street, Dunstable, with stable etc.' - Wheelplough, Park Street, Luton with two adjoining cottages, stable, yard, garden and outhouses and a barn lying between the garden and Blackwater Lane; - private house, formerly Windsor Castle, Windsor Street, Luton; - Half Moon, Pepperstock, Flamstead [Hertfordshire] with adjoining outbuildings and yard and two enclosures of meadow containing 2 acres and a field of arable containing 8 acres with large barn near messuage; - Antelope, Albert Road, Luton with yard and outbuildings in occupation of Lucy Gibbs Third Schedule - Rising Sun [Luton?]; - Black Swan [Luton?]; - Boot [Luton?]; - Balloon [Dunstable?]; - Rose & Crown, Woburn Witness: - Charles S.Benning of Dunstable, solicitor
