    Copy Agreement: Parties: (i) Thomas Sworder the younger of Luton, brewer; (ii) Thomas Sworder the elder of Hertford Reciting: - X95/232; - on 24 Jun 1860 (i) was indebted to (ii) for £20,497/10/1; - since that date (ii) had advanced other considerable sums to (i); - (ii) had, on 20 Aug 1857, become personally indebted to Thomas Foster, Henry Vyse and Edmund Vyse for £4,500 on behalf of (i) and has assigned to them a mortgage of 27 Jul 1853 to himself from (i) and Robert Sworder, his brother; - (ii), at request of (i), by memorandum of 18 Sep 1860 guaranteed repayment by (i) to London & County Banking Company of up to £4,000; - (ii), at request of (i), had become responsible for £2,500 advanced to (i) by Henry Vyse Operative Part: - (i) agreed with (ii) to make a mortgage, when requested to do so, making as security for all debts to (ii) [£20,497/10/1, £4,500, £4,000 and £2,500 making a total of £31,497/10/- at 7.5% interest] (a)-(am) along with real and personal estate to which he, or his wife, became entitled under the wills of: Richard Vyse, late of Luton, esquire of 15 Sep 1854; Thomas Vyse, father of Richard; Robert Sworder late of Stondon Lodge [Hertfordshire], farmer and maltster, grandfather of (i) of 1 Jul 1837; and Robert Sworder of Westmill [Hertfordshire], farmer, deceased, father of (i) of 16 Jul 1842; and under marriage settlement of John Smitheman and Mary Ann Collin (née Sworder) Property: (a) Bedford Road Brewery, Luton including stables, spirit warehouse, premises and brewer's house; (b) Crown & Anchor, Luton adjoining (a); (c) Boot, Burr Street, Luton; (d) Bute Arms, Peel Street, Luton (a)-(d) subject to a mortgage to (ii) for securing £5,000 and interest and to assignment to Thomas Foster, Henry Vyse and Edmund Vyse;(e) all land at rear of (a) since purchased by (i); (f) Queens Hotel, Luton; (g) Green Man, Chalk Hill, Houghton Regis; (h) Crown, Woburn; (i) Globe, Dunstable; (j) all estate of (i) in brewery, land and premises at Dowlas, Merthyr Tydfil [Glamorgan] late in occupation of Robert Sworder (brother of (i)); - (f)-(j) subject to repayment of monies to London & County Banking Company; (k) Saracens Head, Dunstable; (l) house adjoining (k); (m) six cottages near or adjoining (k); (n) three cottages in Houghton Regis; (o) Red Lion, Stanbridge; (p) White Horse, Dunstable; (q) cottage adjoining (p); (r) Waggon & Horses, Luton; (s) land adjoining Railway Station in Dunstable (k)-(s) subject to charge of £2,000 and interest due to William Lettsom (t) Balloon, Caddington [Hertfordshire]; (u) Ewe & Lamb, Dunstable; (v) Cock Beerhouse, Dunstable; (w) George Inn, Dunstable' (x) three cottages adjoining (w); (y) four cottages at Chalk Hill; (z) Waggon & Horses, Toddington [marginal note Caddington]; (aa) house adjoining (z); (ab) Unicorn, Houghton Regis; (ac) 32 acres at Stopsley; (ad) Crystal Palace public house near Luton; (ae) Red Lion, Luton; (af) two cottages and 3 acres near Crystal Palace; (ag) stock of Hertford, Luton and Dunstable Railway to be converted into Great Northern stock to the extent of £1,000; (ah) life insurance policy for (i) for £1,000 in National Provident Office; (ai) Cennen Tower estate, Llandilo [Carmarthen] (t)-(ah) subject to charge of £5,000 to John Smitheman of Hertford (aj) Woolpack, London Road, Luton; (ak) Waggon & Horses, Barton-le-Cley; (aj)-(ak) subject to charge of £700 to Robert Cooke, solicitor of Luton (al) Railway Hotel, Dunstable (am) messuage and land at Winifred Street, Dunstable Witness: - J.H.Fairchild, clerk to Mason & Company of 7 Gresham Street, London
