    Copy assignment as further security: Parties: (i) Thomas Sworder of Luton, gentleman; (ii) Thomas Sworder of Hertford, gentleman Reciting: - will of Richard Vyse of Luton, straw hat merchant of 15 Sep 1854 in which he devised his real estates to his trustees Thomas Foster of Luton and his brother Henry Vyse and eldest son Edmund Waller Vyse upon trusts for sale, the money to be part of his residual personal estate which he bequeathed to his trustees for investment to produce £300 per annum to be paid to his wife Charlotte for life and, after her death or remarriage to divide the principal amongst his children; - mortgage of 27 Jul 1853 in which (i) and Robert Sworder borrowed £5,000 from (ii); - X95/232; - Ellen Charlotte, who had attained the age of 25, wife of (i), was one of nine surviving children of Richard Vyse; her mother Charlotte was still living; - (ii) had become personally bound to executors of Richard Vyse with payment of £4,500 advanced to (i) with the intention of satisfying the condition in Richard Vyse's will for investment of so much of Ellen Charlotte's share of his estate as to produce an income of £150 per annum for her separate enjoyment Operative Part: - (i) assigned to (ii) every item of personal estate to which he, in his own name or his wife's, became entitled under the will of Richard Vyse upon trust to repay the sums of £4,500 and £5,000 and any sum not exceeding £5,000 for which (i) would become indebted to (ii) with interest at 5% Witness: - William Medland of Dunstable, solicitor
