Copy Agreement:
Parties:
(i) Thomas Sworder the younger of Luton, brewer;
(ii) Thomas Sworder the elder of Hertford, gentleman
Reciting:
- (i) was indebted to (ii) amounting, with interest, to £12,335/4/- ;
- (ii), at request of (i), had guaranteed the payment by (i) of any sum not exceeding £2,000 owed to London & County Banking Company on 23 Apr 1857 on condition that any deeds of (i) held by the Company should be delivered to (ii) as soon as (i)'s debts were discharged;
- (ii), at request of (i), had, on 20 Aug 1857, become personally bound to Thomas Foster, Henry Vyse and Edmund Vyse for payment of £4,500 and had assigned to them a mortgage of 27 Jul 1853 in which £5,000 had been borrowed from (ii);
- (ii) had assisted (i) with repayment of the £4,500 in order that (i) might receive the money and use it to pay a deposit on the purchase the brewery and business of Edward Burr and Richard Hatley Crabb
Operative Part:
- (i) agreed to charge brewery and properties purchased from Edward Burr and Richard Hatley Crabb to (ii) as security for repayment of £12,335/4/- owing to (ii), the £2,000 guaranteed by (ii) and the £4,500 for which (ii) was bound - a total of £18,835/4/-;
- (i) agreed that the deeds in the custody of the London & County Banking Company should be charged to (ii) as further security;
- (i) agreed to pay interest on the total sum at 7.5% per annum
