Examination of Edward Swain of the Three Counties Asylum, Stotfold, Medical Superintendent, David Thomas Evans of the same place, Medical Assistant, Henry John North, of the same place, patient and Arthur Brockett of the same place, Carpenter in the presence and hearing of Richard Rawlinson, Attendant, employed in the Three Counties Asylum, that he did unlawfully ill treat James Harvey, a patient detained there. Edward Swain saw James Harvey, who was incoherent, in the presence of Richard Rawlinson. Harvey had a broken leg. Rawlinson said he found him on the floor and thought he had slipped. There were no other marks of violence on Harvey. David Thomas Evans, registered medical man went to see Harvey who was lying on a bed in a single room. Both bones of his right leg were broken. Henry John North was working in the Tailor's shop in the hair picking room. Several patients including James Harvey were there. Rawlinson came into the room and touched Harvey on the shoulder and said 'Come along with me'. North left the room and went upstairs, with Rawlinson and Harvey following. North went into the day room and Rawlinson followed holding Harvey by the collar. Brockett the carpenter was the only other person in the room. Rawlinson put his foot behind Harvey and holding him by the collar threw him back and Harvey fell on the floor. Harvey's necktie became loose and was between his nose and lips. Rawlinson had hold of the tie so that Harvey's head was off the floor and hit him 2 or 3 times with his fist on the side of the neck saying 'I'll murder you, you B----'. Rawlinson helped Harvey up off the floor and helped him into the next ward. Harvey hopped on one leg. He was not lame when he came into the ward. Arthur Brockett, Carpenter at the Asylum, was on the floor working to stop the chairs from the wall. He heard a scuffle and a fall. He looked round and saw Harvey on his back on the floor. Rawlinson took him by his necktie and pulled him into a sitting position and holding him with one hand hit him 2 or 3 time on the neck with his fist.. He heard Rawlinson say 'I'll murder you, you B....'.. Rawlinson helped Harvey and he hopped out of the room with the help of Rawlinson. Fine £10.0.0. Costs 17/-.
