Statutory Declaration by Rupert Bayliss Alley of Rise Cottage, Mill Way, Aspley Guise, retired dairyman:
- he was 67 years old, had been born and lived all his life in Aspley Guise;
- Z1278/2/2/2;
- he believed that no one had exercised the right of extracting sand or clay from the clay pits since 1919;
- since Z1278/2/2/2 he had, from time to time, permitted tipping on the land, impeding the extraction of sand and clay and had never received any protest about it;
- he believed that by 1919 the pit was exhausted with no more sand or clay to extract [note the pit yielded both sand and clay as a geological fault line ran through it];
