    Release and Assignment of Mortgage PARTIES: (i) Martha Howard of Astrey Lodge, Rickmansworth [Hertfordshire], spinster; (ii) John Trustram of Luton, gentleman (son and heir and devisee of John Trustram, late of Luton, innholder, deceased; (iii) Elizabeth Gutteridge of Luton, widow; (iv) Don John Mason of Luton, gentleman RECITING: (I) mortgage by demise for 1,000 years of 21 May 1745 from Parties: (1) (ii) and Mary Trustram (widow and devisee of John Trustram, deceased); (2) William Lucas of Hitchin [Hertfordshire], draper [now deceased]; 1st Operative Part: - (1) mortgaged (a)-(d) to (2) Property: (a) messuage known by ancient name of Royal Oak, Luton, divided into several tenements in former occupations of Francis Peters, Elizabeth Snoxell, John Reynolds and Elizabeth Coe, then of Francis Peters, John Reynolds, John Sherlock and Thomas Lawrence, one tenement being empty, since of John Reynolds, Mary Trustram, Thomas Peters, Edgerton Meacham, widow and Ballady Woodward; bounded by house lat of Abraham Chapman, deceased on one side and messuage of Sir John Napier in occupation of Thomas Knight, baker on the other, fronting the road from Luton to Barton; (b) messuage in Luton, late called the Flower de Luce, now called the Serjeant late in occupation of John Meacham, since William Reeves, bounded NW by Hogg Lane; (c) messuage in Luton known by ancient name of Black Swan; (d) cottage adjoining (c) formerly in several occupations of Richard Willis and Thomas Alnor, then of Thomas Gutteridge and John Sherlock, abutting on one side messuage of Robert Chalkley and on other messuage of William Elkins in occupation of John Freeth, fronting on road near Market Place Reciting: - mortgage by demise for 999 years of 20 Aug 1675 from Robert Long, formerly of Arthstone [Ireland], innholder to William Fisher of Kitchen End, Pulloxhill, husbandman [since deceased] of (e) 2.5 acres of arable land in Bridge Field, Luton of which half an acre lay in Hart Hill alias Hate Hill, one acre in Pepperland furlong and one acre between land of Thomas Winch and Mr.Cheyne; land late of Sarah Long; - land in mortgage had become vested in (ii) for remainder of term of 999 years 2nd Operative Part: - (ii) mortgaged the 2.5 acres to William Lucas (II) assignment of 12 Oct 1750 Parties: (1) William Lucas of Hitchin, brewer (sole executor of William Lucas, late of Hitchin, draper, deceased, his father); (2) (ii) and Mary Trustram [his mother] (3) Martha Howard Reciting: - (I); - 400 remained outstanding (all interest having been paid) as did the mortgage terms of 1,000 and 999 years from separate indentures of 1745 and 1675; - William Lucas was dead but named William Lucas, his son, sole executor of his will Operative Part: - (1) assigned the mortgage and securities [(a)-(e) above] to (3) on payment of 400 (III) deed poll of 14 Apr 1755 Reciting: - (ii) had borrowed 100 from Martha Howard at 4.5% interest and had secured it by a 200 bond Operative Part: - (ii) charged (a)-(e) with payment of the further 100 (IV) Mary Trustram was long since dead, her estate being vested in (ii) (V) The 400 and 100 were still outstanding, with some interest, the sums totalling 595/12/6 OPERATIVE PART: - (iii) paid 250 to (i) with consent of (ii); - (iv) paid 10/- to (i); - (i) assigned (c)-(d) to (iv), by direction of (ii) and nomination of (iii) [habendum: to (iv) for remainder fo term of 1,000 years in trust for (iii) to attend upon inheritance; - (iii) paid 10/- to (ii); - (ii) released (c)-(d) [purchased by John Trustram senior from John Gillam] to (iii) who was now in occupation of both premises [habendum: to (iii) to only proper use and behoof of (iii)] WITNESSES: - Sime Howard; - John Runnington; - John Chapman; - Simon Dove, clerk to Mr.Runnington of Stevenage [solicitor]
