    PARTIES: (i) Edward Burr of Leamington [Warwickshire], esquire; Richard Hatley Crabb of Great Baddow [Essex], brewer; (ii) Thomas Joseph Sworder of Hertford, gentleman; (iii) Thomas Sworder of Luton, brewer Reciting: (I) Z660/D/1/4 (II) will of 21 May 1862 of Thomas Sworder of Hertford, giving and devising all his personal and real estate to his wife Frances Jane Sworder whom he appointed his sole executrix (III) death of Thomas Sworder of Hertford on 20 Mar 1875 which was proved in PPR on 22 May 1875 (IV) Chancery Decree of 24 May 1875 in which plaintiffs were Richard Moss and George Adolphus Boustred for themselves and other creditors of Thomas Sworder of Hertford, deceased and defendant was Frances Jane Sworder and in which it was ordered that Thomas Sworder's real estate be sold, the money being paid into a court account (IV) will of 10 Jun 1876 of Frances Jane Sworder devised and bequeathed to her son Thomas Joseph Sworder all her real and personal estate and appointed him executor (V) death of Frances Jane Sworder on 18 Jun 1876 and proof of her will in PPR on 13 Jun 1876 (VI) Chancery Order of 3 Jul 1876 ordering the suit noted at (IV) to stand revived (VII) Agreement of 18 Nov 1876 in which: - Thomas Joseph Sworder agreed to sell and Thomas Sworder of Luton agreed to buy the brewery etc.in (a)-(ae) below for 45,700, minus the mortgages on certain properties amounting to 19,800; - Thomas Sworder of Luton agreed to raise no objection to the annuity of 250 to Charlotte Sworder arising from part of the properties; - Thomas Sworder also agreed to buy from Thomas Joseph Sworder for 1,559 the reversionary interests of himself; - Thomas Sworder agreed to pay the mortgagees of most of the properties (Edward Burr and Richard Hatley Crabb) a deposit of 4,000, the balance to be paid on or before 25 Mar 1877 (VIII) Agreement of 6 Feb 1877 between (1) Edward Burr and Richard Hatley Crabb and (2) Thomas Joseph Sworder in which it was recited that considerably more than 27,143 was outstanding on the mortgage described in Z660/D/1/4 but that accounts between (1) and estate of Thomas Sworder of Hertford had not been finally adjusted; it was agreed that on completion of purchase in (VII) (2) should permit (1) to receive the balance of the purchase monies amounting to 27,143 so that (1) could concur in the conveyance to (2) (IX) Order of Sir Richard Malins, Judge in Chancery, of 7 Mar 1877 in suit noted at (IV) that the agreements noted at (VII) and (VIII) be carried out (X) Thomas Sworder of Luton paid 4,000 to Edward Burr and Richard Hatley Crabb (XI) Thomas Sworder of Luton paid 23,143 plus 982/15/8 interest at 5% on the sum from 25 Mar 1877 to Edward Burr and Richard Hatley Crabb OPERATIVE PART: - (iii), having paid 27,143 to (i), (i) and (ii) conveyed (a)-(ae) to (iii) PROPERTY: (a) property in Park Steeet, Luton with frontage of 140ft and depth of 310ft, bounded at rear by parish churchyard, together with the following buildings erected thereon: dwellinghouse fronting Park Street with garden behind, let to Mr.Whitelock; stable and storehouse adjoining the dwellinghouse at end of garden, with loft or granary over; storehouse adjoining last storehouse, with loft over; store with loft over, formerly part of the malthouse; malthouse with cistern to steep 40 quarters, drying kiln and screening room; large slated shed with open front; large stable with loft over; large storehouse; range of stabling and stores; stable or cattle lodge; large storehouse; grain warehouse; large yard with entrance gates from Park Street; (b) Two Brewers public house with yard and outbuildings in Upper George Street (formerly called Dunstable Lane), in occupation of Thomas Else, subject to right of way for William Hampson as noted in Z660/D/1/4; (c) Bell public house with stables, yard and outbuildings in George Street, in North End of Luton, in occupation of Mrs.Puddephatt, with right of way as noted in Z660/D/1/4; (d) Griffin public house, Chapel Street (formerly Hog Lane), Luton, in occupation of John McBride; with piece of ground on which public house stood, with yard, stable, coachhouse etc.; (e) Cock public house, Park Street, Luton, in occupation of [Matthew] F[rancis] Collins, with right of way to cottages over the yard; (f) Bull public house, on corner of Park Street and Cumberland Street, Luton, in occupation of F[rederick] J[ohn] Aske with stables, yard and garden; (g) Wheel Plough public house, Park Street, in South End of Luton, in occupation of James Janes, with two adjoining cottages, with stable, yard, garden and outhouses lying behind and adjoining the public house; also a barn lying between the garden and a lane called Blackwater Lane; (h) Blacksmiths Arms public house in Park Street, Luton, in occupation of T[homas] H[enry] Moscrop, formerly known as the Heron; (i) Chequers public house, Park Street, Luton, in occupation of [blank] Biband, with stable and yard, with right of way as noted in Z660/D/1/4; (j) Windmill public house, Gallows Lane, Luton, in occupation of J.Wild; (k) Wheatsheaf public house, Church Street, Luton, in occupation of Samuel Haydon, with stable, yard and barn; with right of way across yard for adjoining tenants and right to use well and coal place in barn;
