Mortgage Parties (i) Justinian Alston of Odell Castle, presently of Mannheim, Baden [Germany], esquire; (ii) Isabella Jane Alston, daughter of (i); (iii) Caesar Joseph Heusch, first liuetenant of artillery, army of Baden; (iv) John James Kerr of Northampton, esquire; (v) Charles Masterman Henning of College Green, Bristol, esquire Reciting: - lease and release and settlement of 17 & 18 Jun 1816, recited in X284/8/2/3; - marriage of Justinian Alston and Mary Kerr and four children resulting: Justinian (eldest son); Mary Elizabeth; Isabella Jane; Crewe of whom Justinian, Mary and Isabella had attained the age of 21; - lease and release and settlement of 1 & 2 Mar 1839, recited in X284/8/4/1; - indenture of mortgage by demise for 99 years pf 22 Mar 1841 between (1) Justinian Alston the elder; (2) Mary Alston; (3) William Tyringham Praed and George Leeke Baker in which (iii) lent 500 to (i) and (ii); the annuity of 600 to (ii) was also demised to (iii); - deed poll of 1 Jul 1841 by Justinian Alston the elder and Mary his wife applying a moiety of the rents etc. of their estates and of the 600 annuity to Mary Alston to pay off debts to tradesmen to Mannheim; - deed poll of 15 Apr 1844 by Justinian and Mary Alston reciting an intended marriage between (ii) and (iii) and directing 3,333/6/8 (a third of the 10,000 directed to the daughters and younger sons by the settlement of 17 & 18 Jun 1816) to be Isabella's portion; - (ii) and (iii) wished to raise 2,000 before their marriage and (v) had agreed to advance that sum secured by a mortgage of 3,333/6/8 and by covenant of (ii) with (iv) as her surety, interest being at 4.25% further secured by conveying (i)'s life estate Operative Part - (v) paid 2,000 to (ii); (i) assigned to (v) his life interest in manors etc. settled by the settlement of 17 & 18 Jun 1816; (ii) assigned to (v) her portion of 3,333/6/8 with proviso for redemption Witnesses: - A.S.Koster of British legation; - George Hume of Great James Street, Bedford Row, solicitor - [......] Envoy Extraordinary & Minister Plenipotentiary to King of Wurttemburg
