- TitleAgreement Parties: (i) Samuel Whitbread of Southill, esquire; (ii) William Wilshere of Hitchin [Hertfordshire], esquire Reciting: - articles of 25 Feb 1800 agreeing that (i) with Timothy Brawn, Jacob Yallowley, Robert Sangster, Benjamin Hobhouse, Jacob Whithead and Joseph Godman would carry on trade of brewers in copartnership at Samuel Whitbread's brewery in Chiswell Street, London for 21 years from 9 Jul 1799 with Samuel Whitbread entitled to two ninths of stock, capital and profits; - Jacob Yallowley had since died entitling Samuel Whitbread to a further ninth share; - at last valuation of of stock etc. of the business on 9 Jul 1802 amounted to 300,000, thus Samuel Whitbread's shares amounted to 100,000; - the copartners had agreed to add to the stock and capital 33,333/6/8 creating a tenth equal share of which Samuel Whitbread agreed to contribute half 16,666/13/4 giving him 3.5 tenths; - (ii) paid (i) two sums of 5,000 on agreement of (i) that he should receive a proportionate amount of the profits of the business, which (i) had done up to 9 Jul 1802; - (ii) had since paid more money to (i) and agreed to pay more up to 9 Oct 1805 to eventually total a full tenth share of the business (i.e. 33,333/6/8) Operative Part: - (i) agreed that on receiving all payments in full (ii) would be entitled to one tenth share of the business and receive one tenth of the profits therefrom; receiving a proper proportion of a tenth until he had made all the payments [i.e. until 9 Oct 1805] Witness: - Lowrey Gilpin
