(v) Charles Livius Grimshawe late of Aspley House near Woburn, Beds but now of Goldington Grange, Beds. Reciting: - Marriage settlement dated 19th Feb 1848 between (1) Augusta Emily Grimshawe (since deceased) (2) Thomas Shuttleworth Grimshawe (since deceased) the father of (1) (3) Donelan Bolingbroke Seymour (since deceased) (4) Charles Livius Grimshawe George Peter Livius (since deceased) and Charles Bolingbroke (since deceased) whereby £4000 which under a power contained in a family settlement dated 3rd Sep 1810 had been appointed by (2) to (1) as her marriage portion was assigned unto (4) upon trust for the separate use of (3) during the joint lives of (1) & (3); after decease of either, upon trust for the survivor; after decease of the survivor, upon trust for the children/grandchildren of the intended marriage. - Will of Thomas Shuttleworth Grimshawe dated 20th May 1848 whereby the trust money contained in the family settlement dated 3rd Sep 1810 (subject to the annuity of £400 to his wife, (since deceased)) was directed to be held unto or upon trusts for his three daughters: Augusta Emily Seymour, Georgina Coke Grimshawe & Caroline Grimshawe in equal shares and the sum of £4000 previously appointed to Augusta should be considered as part of her share. - Thomas Shuttleworth Grimshawe died on the 17th Feb 1850 and probate was granted to Charles Livius Grimshawe and Leigh Richmond, the executors on the 8th Mar 1850. - George Peter Livius died on the 11th Sep 1856 & Charles Bolingbroke died on the 24th Aug 1859. - There have been three children of Donelan Bolingbroke Seymour & Augusta Emily Seymour: (iv), Georgina Emily Ida Seymour now said Georgina Emily Ida Carter & Charlotte Anne Caroline Vaughan Seymour now Charlotte Anne Caroline Vaughan Clarke. - Said £4000 marriage portion was invested by the trustees in the purchase of £5266/17/7 new £3 per cent annuities which were sold and the proceeds advanced to Donelan Bolingbroke Seymour in the respective sums of £4000 and £1082/8/5 on the security of the mortgage securities hereinafter refereed to. - Deed poll dated 26th Apr 1873 whereby Donelan Bolingbroke Seymour & Augusta Emily Seymour appointed the sum of £5082/6/5 to Charles Barham Eyre Seymour and the further sum of £-/1/- each to his two said daughters. - Deed poll dated 11th Apr 1877 whereby Donelan Bolingbroke Seymour & Augusta Emily Seymour previous to the marriage between Georgina Emily Ida Seymour and Richard William Foster Carter appointed £3000 (part of the original said £4000 marriage portion) to be held in trust for Georgina and to be paid to her immediately after the death of the survivor of the said Donelan & Augusta. - Marriage Settlement dated 11th Apr 1877 between (1) Richard William Foster Carter (2) Donelan Bolingbroke Seymour & Georgina Emily Ida Seymour (3) Charles Barham Eyre Seymour, Anthony Hagarty Corley and Montagu Henry Foster whereby it was agreed that £3000 should be assigned unto (3) upon certain trusts. - Deed poll dated 7th Jan 1879 whereby Donelan Bolingbroke Seymour & Augusta Emily Seymour revoked some of the deed poll dated 26th Apr 1873 and appointed the sum of £1082/8/5 together with the residue of £4000 after deducting the said sum of £3000 so appointed to Georgina Emily Ida Seymour, to be vested in Charles Barham Eyre Seymour and payable after the death of the survivor of the said Donelan & Augusta. - Marriage Settlement dated 7th Jan 1879 between (1) Donelan Bolingbroke Seymour (2) Augusta Emily Seymour (3) Charles Barham Eyre Seymour (4) Grace Ann Foster Carter (5) Rev. George Seymour Clarke & Charles Robert Philip De Clermont (6) Montagu Henry Foster John Elliot (since deceased) and Richard Charles Clarke whereby certain real property in Ireland the property of (1) were limited and assured (subject to the mortgages & securities affecting them, see below) to the uses declared for the benefit of (1), (3) & (4). - By the same Marriage Settlement (3) assigned all the money with interest that was appointed to (1) in the recited deed poll of even date (now the 'trust fund') unto (6) upon certain trusts. - The mortgage and securities refereed to in the Marriage Settlement dated 7th Jan 1879 consisted of a mortgage of the town and land of Botal otherwise Bothaul, County Mayo, Ireland for securing £4000 and a mortgage of an estate called Lishenabrone with subdenominations in County Mayo for securing £1082/8/5. Which said mortgages were both vested in Charles Livius Grimshawe as the surviving trustee of the marriage settlement dated 19th Feb 1848. - John Elliot died on the 13th Jun 1880. - Donelan Bolingbroke Seymour died on the 26th Apr 1884 & Augusta Emily Seymour died on the 14th Oct 1880. - After the death of Augusta Emily Seymour the sum of £4673/12/7 was received by the said Montagu Henry Foster & Richard Charles Clarke as the surviving trustees of the Marriage Settlement dated 7th Jan 1879 and the sum of £703/12/7 part thereof was applied to the payment of a mortgage debt of £645 affecting a portion of the property in County Mayo. - Montagu Henry Foster & Richard Charles Clarke as the surviving trustees of the Marriage Settlement dated 7th Jan 1879 have sold the sum of [amount missing] part of the capitol sum of £3873/-/4 India Three & a half per cent stock and paid £3000 (the net proceeds of such sale) to Charles Barham Eyre Seymour, Anthony Hagarty Corley and Montagu Henry Foster as the trustees of the marriage settlement dated 11th Apr 1877 in satisfaction of the portion of £3000 appointed to Georgina Emily Ida Carter. - Transfer of Mortgage dated 22 Mar 1887 between (1) (v) (2) (ii) (3) (iv) (4) (iii) whereby the said mortgage debts of £4000 & £1082/8/5 have been transferred from (1) at the request of (3) to (4) to the intent that the same may be held and applied upon such trusts as stated in the marriage settlement dated 7th Jan 1879. Operative: - In consideration of the interest (i) & (ii) have in the mortgaged premises, (i) and (ii) release (v) from the said sum of £3000 appointed to the said Georgina Emily Ida Carter. - In consideration of the interest (iii) & (iv) have in the mortgaged premises, (iii) & (iv) release (v) from the said sums of £4000 & £1082/8/5 and anything related to the trusts contained in the marriage settlement dated 19th Feb 1848. - Signed by (i), (ii) & (iv). - Witnessed by Robert Dupliex, merchant, Kings County, Ireland and Sarah D.
