PB/O2/4
Title
Case for opinion, reciting:
- appointment by Francis Bragg of Benjamin Woodward as Registrar for life [see PB/O2/1];
- death of Francis Bragg and his succession by Musgrave;
- appointment by Musgrave of Reynolds as Commissary and Whitworth as Registrar;
- the business of the Peculiar had been neglected by Musgrave and Reynolds the inhabitants being "put to great inconvenience"
Opinion of Thomas Reeve:
"An inhabitant &c. in this Peculiar that hath a Right to prove a Will or to have Administration granted there, may have a Mandamus for this purpose to the proper Judge, but I do not see that Mr.Woodward can do anything in this respect. If Mr.Whitworth contests the Title to this Office of Registrar it may be tried at Law"
