  • Title
    (i) Frederick Thomas Tanqueray and Robert Hobourn of Woburn, solicitor's v (ii) Sarah Ann Mann, widow; Groom Cooper Bunker and Sarah Bunker, spinster and infant. Copy joint affidavit made by Frederick Thomas Tanquery and Robert Hobourn of Woburn, Beds in the matter of the estate of John James Reynal Adams, deceased at the High Court of Justice, Chancery Division. (1912 A.No861). Drawn up by Halse Trustram & Co. of 61 Cheapside, London: - Will and codicils of JJRA at HN10/372/Adams1 - JJRA died on the 30th Jun 1909 and his will was proved on the 7th Aug 1909. - JJRA at death was tenant in tail of the Reynal estate in Eggington and Hockliffe, Beds. and held other considerable real estate, part of which consisted of Clipstone Farm, Eggington which had been devised to him by his father John Warner Adams. - Clipstone farm at the death of JJRA was subject to a mortgage called the Wetherall Mortgage (See HN10/372/Adams2) At the time of JJRA's death the mortgage had been transferred to Frederick Augustus Wetherall and William Alexander Wetherall. - FAW and WAW before the death of JJRA requested the mortgage to be paid off and JJRA put Clipstone Farm up for sale by auction in 9 lots (see HN10/372/Adams2). The lots sold for 4490/10/-; 4041/10/- being the residue after agents fees had been paid and 449 was paid to the executors being the aggregate of the said deposits. - At the time of JJRA's death he owed Charles Villiers Somerville Downes 3800 that was secured on a mortgage upon Clipstone Farm (See Downes Mortgage at HN10/372/Adams2) subject, however to the Wetherall mortgage and a prior mortgage dated 7th Apr 1905 for securing 2200 and interest to CVSD, Marian Selina Archer Thompson and Charles Henry Bergne. - Wetherall mortgage was paid to the mortgagees before the fixed date of purchase of lots 3,4,7,8 and 9 by the executors who borrowed money from the London County and Westminster Bank at Leighton Buzzard for this purpose. - Purchase money of 4490/10/- was received by the executors of JJRA for the sale of lots 3,4,7,8 and 9 and 2800 of that was paid to the representatives of CVSD in part discharge of the Downes mortgage. In consideration of the said sum the representatives of CVSD reconveyed Clipstone Farm to the executors. - Before his death JJRA agreed to sell the remaining lots of Clipstone Farm and the profits realised after his decease was applied by the executors to money borrowed from the bank and to the remaining money owed upon the Downes mortgage. - Is (ii) entitled to JJRA's residuary personal estate i.e. did the sale of lots 3,4,7,8 and 9 convert those lots into personal estate and/or what part of the sums secured by the Wetherall and Downes mortgage ought to be bourne by the purchase money of the said lots?
