    Draft Statement by Warry, Robins, Burges & Company of 9 Lincoln's Inn Fields, London regarding Chancery Case Ann Hammond versus Alfred Ambrose: - on 15 Jul 1880 Ann Hammond offered 24-26 Belmore Street and 1-7 Milton Place for sale by auction [see HN10/277/Hammond4]; no sale was made but on 12 Aug 1880 they were purchased by Alfred Ambrose by private contract subject to conditions of sale as printed on the auction documentation, the fourth of which provided that Hammond should deliver to Ambrose an Abstract of Title commencing with a sub lease dated 2 Jun 1870 with proof of covenants and conditions in that and all other leases having been fulfilled to date; - receipt by the Ground Landlord for rent received up to Christmas 1880 read as follows: "January 24th 1881 Wandsworth Estate. received this day of Mr.J.T.Green the sum of Eleven pounds five shillings less tax being one quarter Grounf Rent of Houses in Belmont [sic] Street and 1 to 7 Milton Place Wandsworth Road which rent is received without prejudice to any rights or remedies of the Lessors in respect to any want of repairs by the Lessee"; - 9th condition of sale provided that Hammond being a mortgagee selling under a power of sale should not be required to enter into any other covenant that that she was not incumbered; - current landlord had purchased the superior lease at Christmas 1879 and had always given receipts in the same manner. Hammond's solicitor had applied for a receipt omitting the saving clause but his solicitor's refused so to do; - Ambrose contended that the landlord's receipt did not waive their claims in respect of any breaches of covenant and demanded a clean receipt; - the statement is altered by Alexander Kirby of 14 Great Winchester Street, acting for Ambrose
