- Scope and Content- letter from John Thomas Green at Woburn to Samuel Swaffield - 15 Mar 1861 - "I have a lame story to tell but have much pleasure in giving it as far as I know. By the Settlement made on the marriage of Mr. and Mrs.Brooks two Trustees were appointed for Mr.Brooks' property and two trustees for Mrs.Brooks' property. Mr.Brooks' Trustees were John Brooks and Henry Egerton - you being the new Trustee appointed and now the survivor. Mrs.Brooks' Trustees were the same John Brooks and John Madocks. Mr.Brooks' property you know all about. Mrs.Brooks' property consisted at the time of Her Marriage of the following (excluding Twickenham). Her father Alexr Hatfield's Bond given to the said John Brooks and John Madocks for 2000 to be paid within 6 months after the deaths of himself and his Wife also Mrs.Brooks' share of 4,000 Bank Annuities standing in the names of Sir Rd.Perryn, Samuel Prime and Richard Perryn as Trustees of the Settlement of Mr. & Mrs.Hatfield made in 1788 which Mrs.Brooks was entitled to receive on their deaths this share being by Mr and Mrs Brooks' Settlement covenanted to be assigned to Mr.Brooks & John Madocks when it came into possession - Richard Perryn was the survivor. I have not heard nor did Mr.Green ever know what the 2,000 mortgages mentioned by Messrs Burgoyne represent but I have no doubt the 2,000 is the same as the 2,000 Bond and share of Bank Annuities which were never transferred from Mr.Hatfield and Mr.Perryn (as the Trustees of the Settlement of 1788). I cannot understand how the amount becomes 2,000. If I am correct it is an error that Perryn's representatives have anything to do with the matter and Mr.Green agrees with me that it would be as well for you to write the inclosed Letter to Burgoyne & Co upon the matter as it is thought necessary to appoint a New Trustee in Mr.Egerton's place". - letter from Samuel Swaffield at Ampthill Park to John C.Burgoyne - Mar 1861: "I observe that the settlement of income I received from you a few days ago is headed as being received by the Executor of Mr.Perryn the surviving Trustee of Mr.and Mrs.Brooks' Settlement. I have always understood that John Brooks, Henry Egerton and John Maddocks were the Trustees and that I was appointed a new Trustee in the place of John Brooks deceased I am aware that Mrs.Brooks was entitled to some share of Bank Stock under her Father and Mother's Settlement of which Mr.Perryn was the survivor. Do the 2,000 Mortgages represent this share if not what does the money arise from and how does it happen that Mr.Perryn has anything to do with the Settlement?" - letter from John C.Burgoyne at 160 Oxford Street, London to Samuel Swaffield - 18 Mar 1861: "I find a reference to Mr. & Mrs.Brooks' Settlement (of which there appears to have been Duplicates) that there were 2 separate Trusts created - the one of the Flitwick Property &c. of which John Brooks, Henry Egerton and John Madocks were Trustees. The other was to 2,000 part of Mrs.Hatfield's property of this sum Mr.Richd Gerrard Perryn was appointed a Trustee in 1832 in the place of John Brooks Esqre decd & in conjunction with John Madocks Esqre and having survived the latter, Mr.R.G.Perryn became the sole Trustee thereof, and subsequently lent the Amount 2,000 on Mortgage to Mr.Gingell at the request of Mr. and Mrs.Brooks. As no fresh appointment was made of a Trustee for this money it became vested on the death of R.G.Perryn Esqre in his executors who have acted in the Trust be receiving portions of Mr.Gingell;s Mortgage money amounting to 1,200 and lending that amount, by the request of Mrs.Brooks & her son on mortgage to Mr.Shaw. It appears by a Deed endorsed on the Settlement that in 1839 you were appointed a trustee of the Flitwick Estate in the place of John Brooks Esqre deceased and in conjunction with Henry Egerton Esqre. An attested copy of that Deed was forwarded to Mr.Green of Woburn at his request in 1858. I trust that the explanation will be satisfactory to you, if not, I shall be happy to give any further information that may be requisite. - endorsed "July 11 1870 Corrse with Burgoyne & Co found that Perryn was appointed Trustee of Mrs.Brooks' Money in the place of John Brooks and Swaffield appointed Trustee in the place of the same John Brooks for the Flitwick Estate. This 2,000 was from Hatfield's Estate under his covenant for share prepared after death"
