    Limited Administration, extracted by Burchett & Son, proctors, doctors commons - allegation on behalf of Jonathan Barrett of Croydon [Surrey], esquire Reciting: (I) Lease & Release of 13-14 Apr 1810 Parties: (1) John Harrison of Chelsea [Middlesex] and Richard Harrison of Stony Stratford [Buckinghamshire], esquire (executors of will of Thomas Harrison, late of Wolverton [Buckinghamshire], esquire); (2) William Oliver of Stony Stratford, Henry Langhorn of Watling Street, London and John Oliver of Stony Stratford, bankers; (3) Thomas Meacher; (4) John Chibnall of Newport Pagnell [Buckinghamshire], gentleman Reciting: - Mortgage by demise for 1,000 years of 29 Jan 1791 in which Stamp Garrard lent 250 to (3) on security of Duke's Head, Heath and adjoining acre of land; - assignment of 1 Feb 1802 in which John Harrison and William Harrison (legal personal representatives of Stamp Garrard, deceased who had died intestate, his widow Jane being granted administration and, after her death, administration was granted to John and William Harrison for benefit of the three children, Jane Garrard, Stamp Garrard and Martha Garrard) assigned mortgage (and further advance of 60 of 2 Feb 1791) to Thomas Harrison, 480/11/11 then remaining outstanding of principal and interest on mortgage and further advance; - Lease & Release by way of second charge of 26-27 May 1805 in which (1) conveyed his real estate to (2), his bankers, for a debt of 330 owed to them, (4) being his surety for the loan, to take second place behind Mortgage to Thomas Harrison; - death of Thomas Harrison and his will appointing George John, Earl Spencer and the testator's sons (1) as executors; - the 480/11/11 due to Thomas Harrison had long since been paid off by (3) but no regular assignment of the terms of years had been made by Thomas Harrison; - (3) now owed 410/4/- to (2) First Operative Part: - (3) had paid 480/11/11 to Thomas Harrison; - (4) paid 10/- to (1) - (3) paid 410/4/- to (2); - (4) paid 5/- to (2); - (1), at request of (2) and privity of (3) transferred, and (3) assigned, to (4) all estate of (3) charged with repayment of the now repaid loans together with remaining terms of years; First Habendum; - to (4) in trust for (3) Second Operative Part - (3) paid 10/- to (2); - (2) confirmed to (3) all his real estate charged with the loan Second Habendum: - to use of (3) for ever (II) John Chibnall died without assigning the residue of the term of 1,000 years and made a will in which Charles Marius Hardy and Edmund Goodwin were executors; Goodwin, as sole surviving executor, proved the will in Dec 1829 in PCC and "intermeddled with" the goods etc. of John Chibnall, leaving part unadministered when he himself died, leaving, in his will, his wife Mary as sole executrix, she dying intestate some time later. Letters of administration for the unadministered part of estate of John Chibnall having not being granted he had no legal representative (III) Samuel Reeve, late of Leighton Buzzard, deceased was only person legally entitled to Duke's Head and remainder of term of years and, in his will, with two codicils, appointed Jonathan Barrett and William Exton as executors and trustees for sale; William Exton then declined to act and Jonathan Barrett could not act as there was no legal representative of the estate of John Chibnall (IV) Jonathan Barrett had asked his procter to acquire letters of administration of unadminstered part of estate of John Chibnall Operative Part: - appointment of Thomas Judkins Clarke of Bishopsgate Church Yard, London, gentleman as administrator of unadminsitered portion estate of John Chibnall relating to remainder of term of 1,000 years in Duke's Head, Heath & Reach
