Agreement Parties: (i) Joseph Procter of Leighton Buzzard, gentleman; (ii) William Fossey Pettit of Leighton Buzzard, brewer Reciting: - lease of 31 Oct 1845 between (i) and Charles Reeve of Leighton Buzzard, common brewer [Z1118/1/21/20] of brewery and fixtures [Z1118/1/1/15], public houses etc. in Leighton Buzzard, Heath & Reach, Stewkley [Buckinghamshire] and Ledburn, Mentmore [Buckinghamshire] for 21 years; - during occupation of Charles Reeve (i), at request of Charles Reeve, spent 140 in additions, alterations and improvements to Duke's Head, Heath & Reach, the brewery and messuage and shop in Leighton Buzzard in occupation of John Drage (now by his widow) for which Charles Reeve agreed to pay 7/5/- per annum rent in addition to the 418 already paid; - assignment of lease of 6 Sep 1851 between (1) Francis Bassett, Charles Ridgway and Robert Richmond; (2) Charles Reeve; (3) William Fossey Pettit in which (1) devised the premises to (3) for residue of term of 21 years; - shortly after assignment (i), at request of (ii), spent 420 in purchase and erection of new brewing copper and excavation and building of additional cellars as beer stores at brewery, (ii) agreeing to pay an extra 21 per annum rent on top of 415/5/- already paid; - (ii) had proposed erection, at his own cost, of steam engine and machinery at brewery provided (i), on expiration of current lease, purchased it at a specific valuation, to which (i) agreed Operative Part: - (ii) to pay 436/5/- per annum rent to (i) for remainder of term of years of lease; - (ii), within two years, to erect at brewery a furnace, steam engine and other fittings; - (i), on expiration of lease, to purchase furnace, steam engine etc. (except brickwork and buildings for security of engine and timber necessary to support it) from (ii) at price agreed by valuation, with provision for arbitration Witness: - John Allen of Leighton Buzzard, solicitor
