The following points are noted at the end of the abstract:
1. The certificates abstracted are, I suppose, intended to show the death in infancy of the three children of Henry Hutton and to lead to the inference that this property passed by descent to Joseph Hutton the testator of 1814. There appears however to be some mistake in the certificates relating to Henry Hutton the son
2. The heiship of Joseph Hutton is not shown, and if the vendor has any further evidence of pedigree clearing up this step in the title, it should be produced; but if not I think that the seisin of Joseph Hutton at the date of his will may at this distance of time be assumed.
3. A certificate of burial of Richard Gerrard Perryn should be furnished.
4. A statutory declaration is required for completing the proof that Henry James Cooper Hutton is eldest and only surviving son of John Hutton.
5. The death of John Hutton intestate should be proved by production of letters of administration to his estate or otherwise.
6. If John Hutton has left a widow she is apparently entitled to dower out of his property and we have framed the draft conveyance on the assumption that John Hutton lef ta widow and that she will concur in the conveyance and release her dower.
7. Is the property purchased identifiable as that called Piggs Park in the title deeds?
8. Previously to completion the Succession duty i nrespect of the succession of the vendor to this property should be settled. Subject to the above observations I am of the opinion that the title is well deduced to Henry James Cooper Hutton subject to the right of dower of the widow of John Hutton (if any). The usual searches for judgements etc. should be made in the names of Joseph Hutton, John Hutton and Henry James Cooper Hutton.
9. Will vacant possession be given? If not inquiry should be made as to the terms of the tenancy.
10. The title deeds comprised other property besides that now purchased. I assume that they will be retained by the vendor and that he will covenant for their production.
11. is the vendor's solicitor aware of any change or incumbrance affecting the property not disclosed by the Abstract?
