Deposition: Thomas Holstock, St. Nicholas, City of London, dry cooper.
23 November 1679. Took a gun to shoot sparrows in back yard. Jn. Flint, a servant boy, took hold of small end of gun, plucked the cock, saying: Shoot me, shoot me. Gun went off and fatally wounded J. F. T.H. had no intent to hurt him. The Examinacon of Thomas Holstock of St Nicho Coleabby in the Citty of London, drycooper taken the 23th day of November 1679 before us Thomas Hillersdon Esqr & Robt Crompton Esqr two of his Majesties Justices of the Peace as followeth: This Examint saith that beinge at his Fathers Howse in Elstow in this County there was a Gun borrowed, which hee did take out on friday in the afternoone beinge the 20th day of this instant November to shoot at Sparrowes in a back yard, and one John Flint a Servant boy Aged about 13 yeares, came up to this Examt and layd hold on the Small End of the said Gun; (and pulled it of his Arme,) and said twice together Shoote mee, Shoote mee, the Cock beinge halfe up; and hee beinge all the tyme in pluckinge of it, at the Small End, the Gun went of, and shot the said John Flint into the body; beinge charged with Birdinge Shot whereof hee dyed within 24 houres after hee this Examt haveinge noe Malice or evil will towardes the said boy, nor did Intend any way to hurt him and further this Examt sayth not.
