  • Title
    Abstract of title of Mrs Ann Smith and another to copyhold hereditaments at the Rectory Manor of Stotfold. Abstracting: (Recital I) Z1116/2/1 (Recital II) Z1116/2/2 (Recital III) Z1116/2/3 (Recital IV) Deed Poll dated 1844 (Recital V) Inclosure award dated 26th August 1851 awarding Ann Dilley in lieu of common all that land situate in Stotfold containing 3a 1r 2p numbered 301 on the map of the award. (Recital VI) John Smith died on the 24th August 1853 (Recital VII) Z1116/2/4 (Recital VIII) Indenture dated 4th Sep 1860 between (i) William Doggett of Landon, Herts, farmer; Arthur Doggett of Newnham, Herts, farmer and George Matthew of Troston, Suffolk, farmer (trustees of the estates of the last will of William Doggett dated 12th Feb 1859 and who died on the 10th Aug 1859 (ii) Elizabeth Faircloth. Reciting: - Z1116/2/3 - Default was made in payment of the said sum of 250 and was therefore still owing. - On having the assignment thereafter contained, (ii) agrees to pay sum of 70. Operative: In consideration of 70 (i) assigns (a) to (ii) (a) All that 70 out of 250 secured by recited indenture at Z1116/2/3 with all interest to become due for the said sum of 70. Habendum: (ii) to take and enjoy the 70 interest and premises as (i) enjoyed and enforced the payment of the same. (Recital IX) Ann Dilley died on the 9th November 1860. (Recital X) Elizabeth Faircloth, Thomas Doggett, William Doggett and George Mathew authorised the steward of the manor on the 10th Mar 1864 to enter satisfaction on the court rolls of the said manor on hereinbefore recited surrenders at Recital III and Recital VII. (Recital XI) Memorandum dated 10th Mar 1864 that Ann Smith and Mary Dilley came before the deputy steward of Clement Francis of the said manor and in consideration of 283 and a further sum of 77 owing from AS and MD to Elizabeth Faircloth (360 total) the said AS and MD surrendered property as at Z1116/2/4 to the use of EF upon condition that if the sum was repaid with interest, then the surrender shall be void.
