  • Title
    Abstract of title of Miss Susannah Georgiana Francesca Palmer. Abstract drawn up by Young, Jackson & Beard, solicitors of 12 Essex Street, Strand on behalf of Mr. Pryer who purchased the messuage, orchard and land known as Ivy Lodge on the 4th Aug 1882. (I) Conveyance by lease and release dated the 13/14th May 1809. Parties: (1) James Paine of Gamlingay, Cambridge, farmer and Thomas Hagger of Potton, ironmonger, brazier & auctioneer. (2) John Arch of Clifton, farmer. (3) George Fitz-John of Baldock, Hertfordshire, malster. Operative: - In consideration of £4688 (1) & (3) convey (a-c) to (2). Property: (a) Capitol, messuage or farm house in Clifton with outbuildings and Home Close adjoining of 8a 1r 9p. Home Close and part of the adjoining yards used to be 3 closes: Dixies close of 3r; Middle close of 8a and Long close of 2a 2r. (b) Inclosed pasture land called Audleys of 3a 27p (c) Pasture land called Deans Close of 1a 1r 29p. (a-c) were formerly in the possession of Isaac Bedford, late James Hanscombe and are (or late) parts of a farm and lands of George Edwards, deceased and purchased by James Paine. Habendum: - Unto and to the use of (2). (II) Mortgage dated 16th Oct 1809 Parties: (i) John Arch of Clifton, farmer. (ii) Isaac Hindley of Baldock, Hertfordshire, gentleman. Operative: - Mortgage from (i) to (ii) for £3000 and interest. (i) conveys (a-c) to (ii) as security for repayment. Property: - (a-c) as at recital (I). Habendum: - Unto (2) for 1000 years subject to usual mortgage provisos for redemption. (III) Memorandum dated 11th Dec 1828 whereby interest in above mortgage was lowered to £4/10/- per centum per annum. (IV) Will of Isaac Hindley dated 9th Apr 1829 appointing his wife Mary Hindley and Robert Wilkinson executors. (V) Isaac Hindley died on the 15th Aug 1830. (VI) Will of Isaac Hindley was proved in the prerogative Court of Canterbury on the 18th Sep 1831. (VII) Transfer of mortgage dated 18th Oct 1831 whereby the mortgage from John Arch to Mary Hindley & Robert Wilkinson (See recital II) has been transferred to George Smith and John Smyth of Stevenage, Hertfordshire, drapers and company partners. (VIII) Memorandum dated 17th Feb 1852 whereby the mortgage above has been paid and George Smith and John Smyth are going to continue to act as trustees on the behalf of John Arch until further direction. (IX) Will of John Arch: - Devising: property in Clifton to wife Elizabeth for her life, after to daughter Mary Arch forever; premises not relating to this abstract to son William Arch; property in Clifton in the several tenure of Daniel Tompkins and John Ashby to daugher Mary Arch; All other property in Clifton and Bedford to son John Arch; £100 annuity to wife; £2000 divided between daughers Mary & Elizabeth Arch; £1000 to son William. - £100 yearly rent charged on above property bequeathed to wife. - Interest of £40/10/- per centum per annum to be paid on legacies given to children. (X-XI) John Arch died on the 18th May 1832 and his will was proved in London on the 21st Jul 1832. (XII) Elizabeth Arch (wife of John Arch) died on the 25th Feb 1834 and was buried at Clifton. (XIII) Memorandum of further charge dated 17th Feb 1872 whereby a further charge of £1000 was advanced on the mortgage at (II). (XIV) Memorandum dated 17th Feb 1852 whereby the said further charge of £1000 has been paid. Witnessed by George Smith, John Smith and Thomas Veasey. (XV) Release dated 25th Oct 1857 Parties: (i) Mary Arch of Clifton, spinster. (ii) John Edward Bodger of Cardington, gentleman. (iii) John Arch junior of Clifton, farmer. Reciting: - (X), (XI) & (XII). - Elizabeth Arch (daughter of John Arch, deceased) married (2) and received her right of £1000 from (3) as contained in the will of John Arch, deceased. - Elizabeth Arch died and Mary Arch received her right of £1000 as contained in the will of John Arch, deceased. Operative: - (i) and (ii) release (iii) of payments, legacies, hereditaments and premises devised to him under the will of their father John Arch. (XVI) Covenant for production of deeds dated 4th Apr 1854. (i) Joseph King of Southill. (ii) John Arch of Clifton, farmer. Reciting: - Conveyance dated 4th Apr 1854 between (1) (i) (2) (ii); William Arch of Clifton; David King, farmer and Mary Arch, spinster whereby (a-e) was conveyed to (1) and held in trust by William Arch for (1). - Thereby (1) now held the deeds relating to the title of the following property: (a) Home Stead and Home Close of 8a 1r 9p containing other ground recently forming part of the said close and then conveyed to David King on the N and W. (b) Ground called Hard Leys of 5a 1r 16p formerly two parts called Audleys and Deans Close. (c) Allotment in Shefford field of 21a 3r 15p distinguished in the Stotfold inclosure award as the first allotment to John Arch. (d) Land of 31a 2r 25p and comprising an allotment in Hoo fields of 7a 1r 0p distinguished in the said ward as the 8th allotment of John Arch, (e) Piece of land abutting on the E of (d) of 24a 3r 5p and another allotment of land in Shefford Field and Hoo Field of 118a 3r 5p distinguished in the said award as the 3rd allotment of John Arch. (Note: the said deeds relate to this abstract of title and also of a certain ancient messuage or farm house formerly in the occupation of James Hanscombe, then John Arch, deceased then (ii) together with some part of (a) not sold to (i) of 6a 3r 4p. Operative: - (i) to produce deeds to support rights and title of (ii). (XVII) Deed of grant dated 23rd Jan 1856 Parties: (i) John Arch (ii) Mary Green of Bedford, spinster and Elizabeth Green late of Broom, Southill but now of Bedford, spinster. (iii) William Arch of Clifton, gentleman and Mary Arch of Clifton, spinster. Reciting: - (i) is under liability and engagement to pay (ii) a yearly annuity of £56. Operative: - (i) at the nomination of (ii) grants (a) to (iii) in order to secure the said annuity. Property: (a) Capitol, messuage or farm house in Clifton together with Home Close containing inclusive of buildings 6a now in the occupation of (i). Habendum: - Unto (iii) in trust for (i). - Upon further trust that if default in payment of said annuity, (iii) will sell (a) or as much that suffices in order to pay to (ii) an amount not exceeding £600. (XVIII) Mortgage dated 2nd Jul 1860. Parties: (i) John Arch (ii) William Arch (iii) William Mitchenall of Shefford, draper. Reciting: - (XVII) - William and Mary are still alive but the trust for sale contained in (XVII) has not been enforced. Operative: - Mortgage from (i) to (ii) for £50. (i) conveys (a) to (iii) as security for repayment. Property: (a) property as in (XVII). Habendum: - Unto (iii) in trust for (ii) and subject to the usual mortgage provisos for redemption. (XIX) Memorandum dated 6th Aug 1860 whereby the said sum of £50 on the mortgage at (XVII) has been paid by John Arch. (XX) Conveyance dated 6th Aug 1860. Parties: (i) John Arch (ii) John Mitchenall (iii) William Arch (iv) Mary Arch of Clifton, spinster. Reciting: - (XVII) - (XVIII) - The trust for sale contained in (XVII) is still in force. Operative: - In consideration of £150 (ii) at request of (i) conveys (a) to (iii). (Note: £51/9/6 of this sum is mortgage debt to which (i) is now discharged). Property: (a) Same as property at (XVII) but has since been in theoccupation of (i) and (iv) and is bound on N by land (i) sold to Mr. King in 1854. Habendum: - Unto and to the use of (iii). Covenants: - Trust estate originally set up for (i) is now transferred to (iii) however the annuity as outlined in (XVII) still has to be paid. (XXI) Covenant dated 6th Aug 1860 whereby William Arch covenants to indemnify John Arch from the said annuity. (XXII) Will of William Arch dated 7th Mar 1864 whereby sister Mary Arch and cousin John Henry Whitaker of Henlow, farmer are appointed executors and all household goods, chattels and real estates are given to Mary except those estates that William holds as a trustee or under mortgage. (XXIII) Codicil to the will of William Arch dated 7th Mar 1864 whereby if sister Mary dies before him then the his land should be passed and settled according to her will. (XXIV-XXV) William Arch died on the 20th Mar 1864 and his will was proved on the 21st Apr 1864. (XXVI) Will of Mary Arch dated 11th Mar 1864 Whereby cousin Henry Whitaker and friend John Mitchenall of Shefford, draper are appointed executors and the following bequests were made: - Freehold estates consisting of property at (XX) and late in the occupation of Mr. Way to John Mitchenall. - Property near Foster Street, St. Peter's, Bedford to cousins Mary & Elizabeth Green as life tenants. - Residue of all real estate to be sold by executors upon trust that a general fund is set up out of the proceedings. - £50 and certain legacies to Mr. Calm. (XXVII) Codicil of the will of Mary Arch dated 4th Nov 1864: - Estate at Clifton consisting of two dwelling houses and gardens in the occupation of Geo. Lockey and William Stevens to be given to John Mitchenall upon trust to let out. - Current residence of Mary to be enjoyed by John Mitchenall rent free although subject to Miss Croppers yearly tenancy. (XXVIII-XXIX) Mary Arch died on the 21st Sep 1865 and her will was proved on the 27th Nov 1865. (XXX) Bill in chancery dated 15th Mar 1871 between (i) William Caton (Plaintiff) & (ii) John Henry Whitaker and John Mitchenall (defendants) whereby (i) claims he has not bee paid his entitled legacies under the will of Mary Arch. (XXXI) Decree made in chancery dated 18th Mar 1871 for an enquiry to be carried out into the manner Mary Arch's estates and accounts have been managed since her decease. (XXXII) Chief clerks certificate dated 17th Feb 1874 providing the results of the enquiries carried out by order of the decree at (XXXI) Including: - Legacies given by Mary Arch - Real estate Mary was entitled to at death. - Recital of a conveyance dated 19th Dec 1866 from John James to John Henry Whitaker and John Mitchenall (defendants) concerning the purchase of 2 freehold cottages and ¼ a of land in Clifton which has a frontage to the Clifton and Shefford Road. - A schedule of accounts (first schedule). - A schedule of property(second schedule) that highlights that a dwellinghouse in Clifton was in the occupation of Walter Anderson for a yearly rental of £40 and the grass land adjoining was in the occupation of Charles King for an annual rental of £18/10/-. (XXXIII) Chief clerks certificate approved and filed on the 28th Feb 1874. (XXXIV) Order of sale at chancery dated 23rd Mar 1874 whereby property outlined in Clifton at (XXXII) was ordered to be sold in order to credit the court for the now abstracting suit. (XXXV) Conveyance dated 9th Aug 1875 Parties: (i) John Henry Whitaker & John Mitchenall (ii) Mary Green (iii) Marianna Palmer of Clifton. Reciting: - (XXIV) - (XXX) - (XXXIV) - Death of Elizabeth Green on the 2nd Jan 1872. Operative: - In consideration of £1650 (i) conveys (a) to (iii). - Upon conveyance (ii) releases (iii) of her right to an annuity of £56. Property: (a) Same as at (XXXIV) with a different description… All that messuage or tenements known as Ivy Hall, Clifton of 2a 1r with all closes and pasture land adjoining of 3a 3r and all woods and estates. Habendum: - Unto the to the use of (iii). (XXXVI) Declaration of Robert Lockey dated 6th Dec 1875 relating to the title of the estate at Ivy Hall. - Robert Lockey who worked for many years on the estate for John Arch jnr carefully examined the property and confirmed that it had passed by residuary devise to John Arch (the father) and that John Arch jnr died unmarried on the 7th Nov 1861 and his son William Arch died unmarried on the 20th Mar 1864. (XXXVII) Will of Mariana Palmer dated 9yj Apr 1877 whereby Charles Waring Young of 12 Essex Street, Middlesex was appointed executor and the following bequests were made: - Ivy Hall estate to be devised to niece Susannah Georgiana Francesca Palmer. - Residue of real and personal estate to executor upon trust to sell and give profits to said Susannah. (XXXVIII-XXXIV) Marianna Palmer dies on the 5th Nov 1881 and letters of administration were granted to her executor on the 10th Feb 1882.
