Title
Agreement.
(i) Sir Wm. Langley, bart.
(ii) Fra. Taverner esq. and Rich. Taverner, his son.
Recites recent purchases by the Taverners and by Sir Wm.
Langley. Wm Lord Boteler was recently seised of
26 ac. in the manor. The rector of Higham claims certain
portion of dispersed land in the manor as belonging to the
rectory. John Bellassis to the end that Sir Wm. Langley
and the Taverners should be indemnified against losses
etc. from Lord Boteler or the rector bargained and sold to
Sir Wm. Langley and the Taverners 16ac. of past. cd. Lt.
Highams and adjoining fld. of arable, 52 ac.,
13 May 1641.
By Decree of the Court of Wards and Liveries, 1641, certain
lands were settled on Lord Boteler in satisfaction of
the above 26 ac..
Hen. Lynne, rector of Higham, has now a law suit in Chancery
against Langley and the Taverners, concerning the glebe land.
Lord Boteler could not definately set out in the manor where
the glebe land lay, and neither quantity or quality of the
glebe can be ascertained.
Fine and declaration last Easter term: moiety of Lt.
Higham and Middle fld. to Langley and the Taverners (c.v.).
To avoid differences, agreed:
1. parties will maintain their joint title, and unite to
oppose any suits in repect of Lord Boteler's or the
glebe land;
2. any glebe land that my be allotted to the rector shall
be taken out of Lt. Higham's and Middle fld. only;
3. they will share the loss of the rents of any land
taken away.
4. all costs to be met by money in hand of Fra. Taverner
from sale of wood from Lt. Higham's by John Brace, and
by money of John Bellassis under bond Edw. Wright;
5. future costs of Lord Boteler's lands and the Glebe lands
to met equally by parties.
6. they will make up the amount of the law costs if the
lands do not meet them; and if Lord Boteler reverses
the Decree or the rector produces proof of more glebe
land;
7. if either of the parties or their heirs purchase Lord
Boteler's freehold they shall have the 6ac. past. and
26 ac. arable according to the Decree.
