    Notes on Charles Nicholls' response to a case against him at the summer Assizes, Hertford by the Cripps sisters, who claimed right to dower from property he leased from their father John Cripps, "And Hoopers opinion about the Tythes in the case". Property: a) leased to Charles Nicholls from last 25 March for 7 years: 20 ac land, 4 ac meadow, 10 ac pasture and a sward of wood in Kings Walden and Pauls Walden, and the tythes of corn, grain and hay yearly arising on 200 ac land, and 20 ac pasture in Kings Walden b) copyhold of Manor of Kings Walden 29 acs land and pasture and 5 ac in Flaxmore Field Background: In 1698 Thomas Young of Pauls Walden devised the property in his will to his brother Nathaniel Young. 1705 A deed of recovery gave the use of the premises to Nathianiel Young, the demandant was Thomas Fallowes. 1707 Nathaniel's daughter Mary married John Cripps, and Nathaniel granted the premises and all his other lands in Kings Walden and Pauls Walden in trust for Mary, John and their children. 1708 John Cripps raised a mortgage from Charles Nicholls with repayments of 318 on the lands, with dower, with covenant to levy a Fine. However, no tithes were mentioned in the Fine. 1709 statement of account; 1100 advanced to Cripps. 1712 Lease for 21 years from Elizabeth Young of a 3rd of the premises and tithes to Charles Nicholls [see Z937/18/2]. Nathaniel Young and John Cripps and his wife died leaving 2 children, Mary and Elizabeth Cripps. Mary and Elizabeth claim tithes under the 1707 marriage settlement because tithes were not extinguished by the 1708 Fine. "Examine Sam: Fowler and others whether Young had not 20 acres of coppyhold and five acres execlusive of this estate And if not what is become of the residue they claim onely 13 acres". Names in margin: witnesses to 1707 deed - John Mason, Thomas Barker, Langstone; to Fine 1708 - John Allston, John Field alive, Thomas Field; 1712 - Richard Edwards esq; trustees - Thomas and Richard Bigg, Henry Bedford, George Mills, Thomas Hill.
