    ABSTRACT OF TITLE of Capt. John Edmund Audley Harvey 1924. Recites (I) - resettlement 1871 [see CD 863]; Recites (2) - indenture 1873 [see CD 864]; Recites (3) - revocation of appointment 1877 (see CD 865]; Recites (4) - indenture 1 March 1897 between 1) John Edmund Audley Harvey and 2) John Harvey, first son of JEAH. John Harvey the grandfather died 7 April 1879, in his will of 1873 charged (under power of a Settlement of 11 February 1842) the trustees to raise 4000 for his only younger child Beatrice Susan Audley Harvey and 11,000 to pay her annual income for life from age 25. After her death, the sum was used to clear principal sums charged on his settled and devised estates. All his estates in Hertfordshire, Yorkshire, Nottinghamshire and Lincolnshire and all other real estate to trustees Charles Morris Roupell and Henry Godfrey Astell for 1,000 years, to the use of JEAH for life, remainder to any son he may have in tail male. Plate etc at his mansion house at Ickwell Bury to pass as heirlooms annexed to the house. Recites (5) - will of John Harvey the grandfather proved 12 Jun 1879. Recites (6) - estate sold, balance of 3600 used to buy Lower Padworth Estate, Bedfordshire which was sold in 1890 for 3775, and 4000 to buy an estate not part of this abstract. Recites (7) - trustees were A J Harvey, John Trenchard Tennant esq of the Board of Agriculture, London, and Revd George Montagu Osborne of Campden Rectory, Bedfordshire. Recites (8) - small portion of settled estates in 1890 exchanged for small piece in 2nd schedule. Recites (9) - unsold parts of the estates are listed in 1st schedule. Recites (10) - trustee for the settlement is Charles Henry Tennant. Recites (11) - death of Beatrice Susan Audley Harvey on 19 November 1895, unmarried, part of her 11,000 legacy was used to pay off 4000 charge on the settled estates. Recites (12) - JEAH and JH his son resettled, JH paying 6000 to JEAH. The estate was subject to rent charge of 600 pa in favour of Anne Jane Harvey, as in 1842 marriage settlement. 1st Schedule: - 1st part: - - manors at Ickwell Bury and Northill, Ickwell Bury mansion house now occ by Anne Jane Harvey, widow of JH the grandfather, and arable land adjoining the Park formerly occ by JH the grandfather then JEAH, - farms and farmhouses occ by William Newsam, Robert Newsam, Samuel Landon, Thomes Woodward, William Burton (late Jeffries, Landon and Clark), - all other land of JEAH to which he had reversion in Northill parish except 2 ac 3r 7p in Upper Caldecote which were sold, by the Trustees, to the late Beatrice Susan Audley Harvey in 1890, and the reversion of Ickwell Old House at the SE corner of Ickwell Green, with stables, coachhouses, small paddock, etc, occ by Charles Fyshe Palmer, then Susannah Harvey, widow, deceased, mother of JH the grandfather, containing 3a 1r 2p, - Home Close or Lt Moat Close 2a 3r 4p, - Gt Moat Close 4ac 1r 36p held by Henry Godfrey Astell under 99 yr lease from Oct 1875, - messuage with garden, 2 cottages, paddock and close 2ac 2r 6p on E of Ickwell Greeen occ by George Course, Elizabeth Burnage and William Summerfield, - Harveys Close enclosed pasture, partly ancient inclosure and partly land allotted under Northill Inclosure Act, with spring or grove at NW corner, 6ac 3r 22p, - Marsh Corner lying between Harveys Close and road to Biggleswade 5ac 10p, - Marsh Field close 11ac 5p, Hedge Field close 13ac 3r 25p, Printings Close 20 ac, 3r 39p, Beesons 28ac 3r 16p, Turnpike Close 31ac 20p and College Piece 19ac 22p, all allotted to a predecessor of Charles Fyshe Palmer, - messuage, farm homestead and paddock 2ac 3r 15p on S of Caldecote Green, formerly one farm, occ by Griffin Cant, with Covin Close since sold to George Inskip decd, all sold to JH the grandfather 1842 in conveyance between 1) Charles Fyshe Palmer 2) JH the grandfather 3) William Astell, later conveyed to John Harvey Astell and Charles Barnett 1851, - freehold close 4ac 3r Upper Caldecote as described in indenture 1845 between 1) Frederick Hogg and William Lindsell 2) JH the grandfather conveyed to JHA and CB by whom it was purchased with the proceeds of the sale of Covin Close. 2nd part: - 3 cottages with bakehouse etc at Northill converted from blacksmith's and wheelwright's shops, occ by George Course, formerly by John Boff, William Brunt, after by Thomas Eaton Rolfe, William Osborn, James Shelton Brown and others, conveyed to JH the grandfather 1842 by conveyance between 1) Revd Robert Hepworth 2) Thomas Preston 3) JH the grandfather, - 11ac 3r 16p arable in Ickwell Field, mostly in Northill but a small portion on S or SW in Warden, - 2r 16p strip of land running E-W containing a spring and hedgerow bounded S by Hill Lane, and all other sides by JEAH, received by JH the grandfather from Rt Hon Lord Ongley in exchange for lands described in indenture 1843, - dwellinghouse called Highlands in Northill with stables, farm, etc, and land 383ac 28p formerly occ by William Henry Burch Rosher - Sweet Briar Farm in or near Warden Street, Old Warden, with 121ac 9p land, forerly occ by Robert Neal, described in conveyance 1858 between 1) William Rosher and Isabella Bellinda his wife 2) JH the grandfather, - 15c 2r 31p close at or near Thorncote, Northill, bounded N by Godfrey Thornton then Stephen Thornton and late Godfrey Thornton the Younger decd, then JEAH, on E and S by the incumbent of Northill, W by road to Thorncote, conveyed1858 from Revd George Thornton to JH the grandfather, - farmhouse, cottages and land 136ac 0r 9p formerly 2 farms the inheritance of Godfrey Thornton the Elder decd, described in schedule of conveyance 1850 between 1) Seymour Fenlow 2) Sir Robert John Harvey and others 3) William Davies Adams 4) John Spurgin 5) Thomas Blackall and Henry Walmsley 6) Henry Thornton and Charles John Pearse 7) JH the grandfather, - cottage and 1r land and rights of common pasture at Thorncote, formerly estate of Robert Thomas long since deceased, - cottage adjoining the above cottage since erected on part of the ground, - 1a close adjoining or near the above garden, once part of same estate, later occupied by Thomas Gillion, - 1a adjoining close called the "Field", Thorncote - these last premises described in sale particulars as freehold cottage or double tenement with barns etc, and 2a 2r 23p of freehold garden land adjoining, bounded NE and S by John Harvey esq, W and SW by the Green and Messrs Rosher and Field; Recites (13) - indenture 1 March 1897 from 1) JEAH to 2) JH 3) George Frederick Alexander Bashford of 8 Portman Mansions, Baker Street West and The Naval & Military Club, Piccadilly, late Capt in Scots Greys, and Sir Algernon Kerr Butler Osborn of Chicksands Priory, Shefford, Bart (trustees). With 600 pa rent charge in favour of Anne Jane Harvey, to the use of JEAH for life, in fee simple. Property: [see CD 863] plus 1r land at Thorncote, Northill formerly for some years occ by Charles Fuller, shown on plan in conveyance 15 March 1893 between 1) Jeremiah Lillium Rosher 2) Patrick Blair and Hugh Blair 3) Henry Field 4) James Robertson and Thomas Ness 5) Henry Dillamore 6) Charles Morris Roupell, Anne Jane Harvey and John Henry St Quintin Astell. Recites (14) - as part of the family arrangement, JH paid his father JEAH 6000, and JH and JEAH had the right to money held in trust by 1st codicil to will of Beatrice S A Harvey. Proviso that JEAH may raise up to 6000 on the property. Proviso that JEAH may appoint to RA Harvey or MRB Harvey a yearly rent charge which would cease upon certain events. Proviso that JEAH should not fell any timber in the park or demesne of the mansion house in Ickwell Bury unless agreed in writing with JH. Recites (15) - Anne Jane Harvey died 12 July 1898 Recites (16) - Appointment of new Trustees 1 May 1899. 1) JEAH 2) Charles Henry Tennant 3) GFA Bashford and Sir AKB Oborne. Recites (16i) - Robert Henry Lindsell and (2) were Trustees of the Settlement, and exercised the usual power of sale only once, in 1890, regarding a small part of the settled estates - the money raised was used partly to purchase a small piece of adjoining ground and partly to purchase 445 1s. 5d 2 % Consols. Recites (16ii) - Robert Henry Lindsell died 15 July 1891. Recites (16iii) - There was doubt about the legality of deed 1 March 1897 because JEAH had only one son, ie. JH, and the wording applied only to the eventualities if he had more than one son. Recites (16iv) - (2) desired to be discharged as Trustee. Recites (17) - indenture 21 July 1911 between 1) JEAH and 2) JH declaring the 1897 deed of appointment invalid, the estate is still subject to trusts and powers subsisting before then. So (1) extinguished the powers given to him in 1897 over all property in 1st and 2nd schedules to the appointment, and all other lands subject to settlement of 1871 and deed 1877. (2) discharged all claim respecting the 6000 because JEAH had used it for the benefit of the settled estate and therefore for the benefit of (2). Recites (18) - mortgage 4 January 1915 between 1) JEAH 2) JH of 8 Ranelagh Grove, Ebury Street, London, Capt in HM Irish Guards 3) GFA Bashford of 17 Prince of Wales Mansions, Battersea Park, SW, late a Capt in Scots Greys, and Sir AKB Osborne of Chicksands Priory, Bart (mortgagees), of 1483 for 99 years. Recites (19) - indenture 12 June 1919 between 1) GFAB and Sir AKBO (mortgagees) 2) JH of Northill Grange, DSO, Lt-Col in HM Army 3) JEAH. Recites (19i) - 1483 remains owing. Recites (19ii) - JEAH agrees to convey to JH his life estate so that, subject to rent charge of 1320 in favour of JEAH, such estate will be merged in the inheritance, and the life estate in remainder of JH will be accelerated. Recites (20) - indenture 12 June 1919 from 1) JEAH to 2) JH, the Harvey family estates then remaining unsold. Recites (21) - mortgage 13 June 1919 by 1) JH who further secures the 1430 from 2) GFAB and Sir AKBO (mortgagees) Recites (22) - deed of appointment 19 January 1922 between 1) JEAH 2) Frederick William Fane esq of 1 Fleet Street, London and Sir AKBO, new trustee Recites (22i) GFAB died 23 October 1921
