Indenture tripartite between 1) John Harding and Susanna Harding 2) John Pennington 3) Francis Brace [This indenture was made at the same time as the lease recited in X868/1 and the recovery in X878/1: they all form part of one transaction. The only difference is the acreage described in (b):] b) 1 ac close formerly occ by Richard Crofts now occ by John Smith alias Lyant, etc Recites: the premises are at present in the actual possession of Francis Brace ("tenant of the freehold") by virtue of a bargain and sale of 5s for one year commencing at the Feast of the Anunciation of the Blessed Virgin Mary last past [25 March] and by an Indenture of 2 May 1709 between (1) and (3) and by force of the statute transferring uses into possession Includes: declaration barring all estates tail, remainders and dower Recites that party (2) may, before the end of Easter Term next ensuing, "sur disseizen en le post" to be returned at the Court of Common Please by which (2) shall demand to recover the property from (3) Witnesses: T Sayer and Wm Houlker
