He died on 16 February 1879. Will proved (PPR) on 7 April 1879 said £500 is still owing now in consideration of £500 paid to (i) by (v) at request of (ii), (iii) and (iv) and also in consideration of £1400 paid to (ii) and (iii) by (v) with consent of Sarah Deacon, spinster, Matthew Timberlake and Charlotte, and Annie Deacon (total - £1900, being the agreed purchase money) now (i) at request of (ii), (iii) and (iv), convey, with the confirmation of (iv), to (v) - The Cross Keys, etc, late in occupation of Septimus Abbott and now of George Tack to be held freed from mortgage debt of £500 and from trusts of will of Thomas Deacon, deceased sigs of (i) to (iv) endorsed wits Richard Cooke, solicitor, Luton Henry B Scard, clerk to Mr Cooke solicitor, Luton also endorsed with acknowledgement by Charlotte Timberlake 5 January 1880 attached: certificate for taking acknowledgement of deeds by married women, concerning Charlotte Timberlake's consent to the above
