reciting above mortgage. Mortgage on property 2ndly described has long since been paid off
reciting will of Frances Mortlock of 12 October 1861 by which she appointed her mother, Margaret Mortlock, sole executrix and bequeathed to her all her real estate including estates vested in her by way of mortgage, and also all her personal estate. She died on 1 July 1862.
Will proved (PPR) in May 1865
reciting will of Margaret Mortlock dated 7 May 1870 by which she appointed (i) as her executors. Estates held by her on mortgage to be held on trust affecting the same. Money secured to form part of personal estate. She died on 15 October 1874. Will proved (PPR) on 17 November 1874.
reciting will of Thomas Deacon dated 15 September 1868 by which he appointed (i) - ie his wife and 2 sons - executors, and after disposing of his personal estate, he devised to wife for life, all his real estate. After her death, to go to his sons in trust for sale. He died on 17 September 1868. Will proved (Northampton) 19 December 1868.
Said principal sum of £850 still remains due to (i), but all interest has been paid to date. (i) can only repay £350 so have requested (iii) to lend them £500. now in consideration of £350 paid by (ii) to (i) and of £500 paid by (iii) to (i) at request of (ii) (total £850)
