Scope and Content
i) John Sellis, younger, Blunham, maltster
ii) Francis Wingfield, Potton, gentleman
It is agreed as follows: 1st - in consideration of £1000 i) will convey to ii)
- messuage or farmhouse etc in Sandy once in occupation of Mr John Brittain
- arable land, leys, meadow, pasture ground etc belonging
- cottage etc adjoining said messuage and now in occupation of John Cooper and Mary Raven
- all other property of John Brittain at the time of his death whereof Baron Brittain, brother of the said John Brittain, or John Sellis or wife Edith stand seised since the death of John Brittain, in Sandy or adjoining villages
also - i) covenants to levy fine before end of next Michaelmas term to ii)
also - ii) agrees with i) that he will pay all monies due on respective mortgages (provided same does not exceed said £1000 and mortgagees assign their interest to him) and will pay residue to i) for full payment for the premises when the fine and conveyance are perfected
also - is agreed that ii) may enter onto and take the rents of abovementioned premises at Michaelmas next and may enter the premises to repair or amend them
also - ii) will bear the expense of the conveyances and fine and ii) to bear expense of the assignmen of the mortgages and the cost of any suit to procure a good conveyance of the premises. ii) to have liberty to make use of name of i) in any suits for the purpose.
also - i) will rent and hire the premises until the Annunciation 1739 at rate of £50 p.a. by equal half yearly payments
also - i) will not plough or convert into tillage any of the meadow or pasture ground under penalty of £5 per acre and will keep fences, thatching, chimneys etc in good repair and will at the Annunciation, 1739, yield them up to ii).
