Reciting that James Howard made his will dated 22 May 1888. He died on 25 January 1889
Now in consideration of £175 paid by (iii) to (i) and another £175 to (ii) (total - £350) (i) and (ii) convey to (iii)
- piece of land partly in parish of St Peter Martin and partly in Goldington (2a 3r 5p) (coloured green on map in margin) with messuage, or lodge thereon
(iii)covenants with (i) and (ii) to indemnify them against all liability in respect of covenants in deed of 15 November 1873, being a conveyance of 2r in Goldington, part of above property, and in deed of 25 June 1864 relating to 2a 2r in St Peter Martin (part of above property)
Said property forms part of the Clapham Park Estate sold by James and Frederick Howard to (iii). Whole estate, other than above property, has been conveyed by (i), as surviving proprietor, on the Register in the usual statutory form
However doubts have been raised whether this has been effectual to pass the mines and minerals, as they are not specifically mentioned on the Register
Now (i) and (ii) grant and confirm to (iii)
- all minerals in and under said lands to use of (iii) signatures of all with J H Howard acting as attorney for Geoffrey Howard
