Reciting will of John Foster, formerly of Brickhill, St Peter's, Bedford, Esq, deceased, dated 22 January 1829, by which he appointed all the properties etc settled by his marriage settlement, to his children by his wife, Amelia, as tenants in common. By codicil of 27 June 1831 he changed his executors.
He died on 30 June 1831. Will proved (PCC) on 14 February 1832 by John Frederick Foster and William Morris
He left 4 children by his wife Amelia, ie Arthur Fitzjohn Foster, (v), Mary Amelia Fuller and Flora Dawson
Reciting marriage settlement of (i), dated 17 September 1834 and of (iii), dated 6 June 1836
Arthur Fitzjohn Foster died in 1842 a bachelor.
Reciting deed of 28 March 1861 being the appointment of new trustees of marriage settlement of (iii)
Reciting death of Amelia Foster, widow, in February 1849
(ii) as surviving trustee of settlement of 17 September 1834, has agreed with (v) to sell him 1/3rd part of said messuage, farm etc for £3333 6s 8d
(iv) as trustees of settlement of 6 June 1836, with consent of (iii) have agreed to sell another 1/3rd part to (v) for £3333 6s 8d
Now in consideration of £3333 6s 8d paid by (v) to (ii)
(ii) with consent of (i) and direction of (v) convey to (vi)
- one undivided 1/3rd part (subject to trusts of deed of 17 September 1834) of
--- messuage called Brickhills House etc
--- messuage called Brickhills Farm
--- lands as in Schedule, situate in St Peter's, Bedford
Also in consideration of further £3333 6s 8d paid by (v) to (iv)
(iv) with consent of (iii) and direction of (v) convey to (vi)
- one undivided 1/3rd part (subject to trusts of deed of 6 June 1836) of
--- messuage called Brickhills
--- farmhouse hereinbefore described
- deeds concerning the title except settlement of 6 June 1836 and Appointment of 28 March 1861 (which (ii) covenants to produce) to be held by (vi) on trust to use of (v)
(v) declares that any widow shall not be entitled to dower out of said property
