recites: will of Fran Ashton and death of Eliz Rayner 'long ago' without issue new trustees of will have been appointed from time to time. In 1795 some of the property in Dunstable devised for poor clergymen and clergy widows were sold in pursuance of order of High Court of Chancery in case Attorney General v Thos Aynscombe and others. Net proceeds of sale invested in 3% Consols.
By lease and release of 15 and 16 April 1816 bet a) Augustus Robt Hanley (surv exor and trustee) and b) i) and Robt Long, dec., the manors and lordships therein desc being all property now subj to the trusts, were assured to use of a) and b) in trust On 9 Aug 1831 the Attorney Gen filed information in Chancery ag b) - a) having died on 9 Aug 1831 - asking that an account be taken of the rents and profits of the Charity estates and that Master might state to sd court what was actual value of sd Charity Estates and that the dfts (or at least Robt Long) might be removed as Trustees and that the Master might approve a scheme for the proper management of the Charity
It was decreed in 27 Jan 1835 that when Fran Ashton provided for the appointment of new exors, she meant trustees. New scheme made. Master of Court of Chancery appointed 3 new trustees of the clergy charity (total 5) in place of Robt Long, Wm A Hankey (retired) and Aug R Hankey (dec), and 3 others for almshouse charity (total 8)
By Order of 10 May 1848, Master appointed ii) as new trustees, tog with Thos Hankey, of clergy charity, and iii), to act with them, as trustees of almshouse charity. By a Report of the same date the funds of the charities were stated
The Master has approved this deed (as witness his signature in the margin of each sheet) now, i) releases to ii) Firstly:
- Manors of Edlesborough and Chadwell in Bucks
- Fitzhughs Farm at Edlesborough formerly in occ Stradbridge Ginger and then of Thos Ginger
- Boswells Manor house and farm at Edlesborough, formerly in occ Jas Evans, then of Sam Hawkins and since of Thos Ginger these last 2 now in occ Wm Prinnett as described in the 1st part of the 1st schedule to this deed being a copy of the 1st part of the 4th schedule of the Report, and as on the plan attached
- Dovehouse Farm, near Kensworth, Herts, formerly in occ Dan Liberty and now in occ Wm Reave, as described in 2nd part of 1st schedule (copy of 2nd part of 4th schedule of Report) and as on plan
- piece enclosed arable (estimated to cont 8acs, but now measured as 6acs 7p) at Leighton Gap in Dunstable formerly in occ Mary Shaw, wid, then Dan Queneborough, dec, since of Jos Gutteridge, and now in occ Rich Gutteridge (numbered 3 on attached map)
- enclosed ground in place formerly called Saval Field (1½ acs) late in occ Dan Queneborough
- rent of £100 payable out of above mentioned premises Secondly:
- farm near Luton formerly in occ Jos Williamson, then of Thos Davis, which now comprises a farm at Church Street, Luton, and a farm at Cowridge End, Luton, in occ Dan Davis as in 1st and 2nd parts of 2nd schedule being copies of 1st and 2nd parts of 3rd schedule of Report, and as on map
- Church Field (est 4 acs, measurement 1a 2 rds 32p) on E side of London
- Holyhead Road in Dunstable, formerly in occ Mary Smith and now of - Bass
- Vinegar Acre (est 1½ acs, measurement 1 ac 1 rd 16p) in Dunstable, formerly in occ Jnthn Swift, now of Chas Farr - 6 almshouses in south angle of crossing of main roads in Dunstable
