    Assignment of mortgage 1 Elizabeth Rudd, Weybridge, Surrey, widow (mortgagor) 2 George Palmer, Goldington, Guardian of William Wagstaff, minor, son and heir of William Wagstaff, Wilden, gent and Mary his wife both deceased. 3 Thomas Woodward, Bedford, gent (mortgagee for 2) Recites X 631/6-7 Whereas indenture of 11 Feb 1733/4, X 631/7, was not executed by William and Mary Wagstaff but only by Thomas Browne caused by sudden death of Wm Wagstaff, so that £62 10s to be paid by Henry Fleming to Wm Wagstaff was not paid, so that the whole principal money charged upon the premises was no more than said £287 10s paid by Hen Fleming to Thomas Browne. Recites X 631/8 Whereas Mary Wagstaff and son Wm Wagstaff junior did not pay £343 or any part of it to Elizabeth Rudd by 11 Aug 1738, the estate interest of Elizabeth Rudd did become absolute for the remainder of the said several terms of 1000 years. Whereas Mary Wagstaff is also deceased whereby the annuity of £15 payable during her life time is ceased. Whereas there is now due principal sum of £343 and £27 9s being 2 years interest making £370 9s which the said Elizabeth Rudd insisted upon payment. Whereupon said George Palmer has been obliged to raise the money and upon the application to the said Thomas Woodward he hath consented to lend and advance the same. Witnesseth 1 conveys to the use of 3 consideration of £370 9s at the request of 2 in full discharge of the principal and interest assigns all premises to 3 for residue of 1000 years and 1000 years yet to come. And Elizabeth Rudd has done nothing whereby the said premises could be impeached or encumbered in tithe charge estate or otherwise. Provided always Agreed between 2 and 3 that if Wm Wagstaff minor or heirs and assigns or anyone on his behalf pay to 3 £370 9s with interest at 4% annually upon 11 Feb next [1743/4] at the dwelling house of Thomas Woodward at Bedford, 3 to transfer the said lands and premises to Wm Wagstaff heirs and assigns or devised persons. Further Witnesseth George Palmer as well as consideration of £370 9s paid at his request by Thos Woodward to Elizabeth Rudd, shall receive rents of the premises as guardian of Wm Wagstaff and shall pay the interest due half yearly or 3 calendar months after each half yearly payment to avoid arrears of interest.
