  • Title
    Mortgage [printed] i) Jophn Hollway ii) Francis Retallack iii) Frederick Bassett ii) and iii) have advanced £1500 to i) in proportions of £750 each on an agreement that repayment and interest of said aggregate sum of £1500 should be secured to ii) and iii) as joint tenants but principal money should in equity belong to ii) and iii) as tenants in common. Now in consideration of said £1500 (i.e. £750 plus £750) i) covenants with ii) and iii) to pay said sum and interest in the meantime at 3% p.a. from 24 June 1907 Also i) conveys to ii) and iii) - messuages, lands etc in Treamble [as conveyed above]. i) covenants to keep buildings in repair and to insure property in at least 3/4 of full value in joint names of all of them. If default made then ii) and iii) may effect such repairs and insurance themselves i) may grant mining setts, leases and licenses for period not exceeding 42 years provided such leases etc shall contain all usual provisions of Cornish mining leases and especially provision for payment of £80 for every statute acre of land destroyed. Proceeds to be used to reduce mortgage debt ii) and iii) will concur in any steps necessary to recover mortgage debt, if necessary If i) on days interest is payable, or within 30 days of dispatch of registered letter demanding payment, pay to ii) and iii) interest and sum of at least £100 for each of 15 years commencing 1911 and perform all covenants then ii) and iii) will not call in said sum before 31 December 1925 signatures [printed] and same witnesses as above
