Parties
(i)Thomas Giddings and his wife Susanna as in /2/1(i).
(iiWilliam Giddings of Duloe, carpenter, son of (i).
Recitals
Indenture of Mortgage by Demise as in /1. ((ii) in /2/1 being referred to as 'since deceased')
That no fine was levied in pursuance of the covenant in /2/1; and the principal sum of £130 with some interest now remains due to the estate late of John Topham.
Operative part
Grant and release (operative words being 'grant, bargain, sell, alien, release, surrender and confirm') from (i) to (ii), in consideration of the natural love and affection they bear to (ii) and 'for his advancement in the world', of:
(a)3 messuages, cottages or tenements in Duloe in Eaton Socon, one being a Public House known by the sign of the Anchor (and another lately built on (b)) [one or more of which would have constituted the messuage in /2/1(a)]
(b)plot or parcel of land as in /2/1(b), now or late in the occupation of Thomas Giddings.
General words clause as recited in /2; ... together with all 'deeds, evidences and writings relating thereto'.
Habendum: to (ii) to the following uses ie to
corroborate and confirm the mortgage in /2 and the term of 1000 years and, after the end or other determination of that term, to (ii) in fee simple.
Covenant by (i) to acknowledge and levy a fine or fines sur conuzance de droit come ceo etc of (a)-(b) to (ii), as of Trinity term last past or before the end of Michaelmas term now next ensuing, to be and enure to the uses declared above.
