Statutory Declaration by John Warner Smith of The Bury, Stevenage [Hertfordshire], yeoman that:
- he was 58 and upwards;
- he was well acquainted with his late uncle Thomas Smith;
- he knew of mortgage Z 1036/3;
- he knew of attornment Z 1036/6 of cottages described as being in Ampthill Street, formerly known as Tanners End;
- Thomas Smith died on 15 Jul 1852;
- John Warner Smith's brother Thomas Deacon Smith, who had derived the cottages under the will of Thomas Smith, died on 18 Feb 1866 and John Warner Smith had received the rents of the cottages as agent since then;
- that since the mortgage Z 1036/3 was made no intermediate acknowledgement of the title of William Fensham, otherwise Fensom or right of redemption had been made
