(Copy) Case and opinion of Counsel. Rec. that p'ship of Barnard & Green was dissolved in 1826, and had since been carried on by Thos. B. alone. At time of dissolution a large no. of cash notes of the old p'ship were in circulation, and an agreement was made to pay them as they came in & cancel them. To save Stamp Duty on new notes, Barnard reissued them, having printed on them 'Reissued by Thomas Barnard'. B. holds that this is sufficient notice that he alone is liable for payment. Green is not satisfied. Is he liable also? Opinion of R.V. Barnewall :- Green could be held liable since there is nothing to prove that the notes were not issued with his consent. The notes should be taken out of circulation.
