i) is indebted to ii) in 600. ii) having requested i) to secure said sum, i) has agreed to assign by way of mortgage the said sum of 700.
Now in consideration of 600 owing to ii), i) assigns to ii)
- said sum of 700 expressed to be payable under mortgage of 4 December 1867 and excepted in his favour by Agreement of 13 February 1873 on trust to retain for himself 600 and interest at rate of 5% p.a. and to pay surplus to ii)
