    Draft mortgage 1862 i) Benjamin Bennett ii) Thomas Sworder, Luton iii) Thomas Sworder, Hertford, Hertfordshire, gentleman iv) John Cook, Bramingham near Luton, farmer reciting above mortgage of 14 January 1862 also reciting that the property had previously been charged with payment of 700 and interest to John Cook, Stamford, surgeon. He had also charged the firstly described property with payment of 700 and interest to Richard Cook and other property with payment of 500 and interest to Jane Cook of Stamford, widow, and the deeds etc were deposited woth Richard Cook for same sums of 700, 700 and 500 but no legal mortgage to i) of 2ndly described property has ever been made. Incorrect recital was made in above deed as to interest of Richard Cooke and amount due to him frm ii) On about 1 October 1862 ii) agreed to sell to iii) for 357 10s all the property 1stly and 2ndly described but subject to payment of principal and interest charges all principal and interest as in deed of 14 January 1862 has been paid off as i) admits ii) has been applied to for payment of monies now due (1700 - as 200 has previously been paid off the amount charged in favour of Jane Cook) now in consideration of 1700 paid by iv) to ii) i) at request of ii) and iii) - as to premises 2ndly described - grant and convey, and iii) at request of ii), confirm to iv) 1stly - piece of land formerly part of Langley Piece North-West road from Luton to St Albans South-West other part of said close, new belonging to Richard Vyse North-East other part of said close etc now property of Mrs Ellison South-East inner part of said close now of Frederick Chase - messuage lately built on said piece of land and converted into a public house called the Wool Pack, now in occupation of John Deeley - messuage since erected and built on said piece of land formerly in occupation of William Sharp, since Sophia Smith and now of John Gardiner - messuage etc built by William Chesher on part of land now converted into a public house and called the Wagon and Horses in occupation of James Timms - 2 cottages adjoining to messuage lately built by W Chesher, late in occupation of Payne and Ward, now James Timms - piece of land at Barton in the Clay (16perch) lately divided from the garden of Thomas Sturges North residue of said orchard West Edward Willis, Esq East common street or highway 2ndly - 4 messuages in Manchester Street, Luton, erected on land purchased by ii) of the Trustees of - Wren, deceased and now in occupations of Matthew Judge, William Loyten, John Flavell and Francis Merchant - piece of land at back of said 4 messuages where stood 4 cottages which have been pulled down and the land used as a drying ground Last described premises were conveyed to ii) by description - Waterside House fronting on road from Luton to Horsepool, opposite Tower Hill, now converted into 4 cottages, later 5 cottages, one of which is unoccupied and the others are in the occupations of Ann Wren and Henrietta Wren, James Hill, Henry Lawford and Mr Johnson - 2 other cottages adjoining the last and erected by Joseph Wren deceased, and now in occupations of John Impey and John Day - 4 other cottages near last mentioned also erected by said Joseph Wren, and now in occupations of James Brown, William Himsey, William Scales and William Parsons - building, wheelwright's shop and premises standing opposite to last mentioned cottages, with yard, garden and orchard to hold to use of iv) discharged from said sum of 700 and interest as in deed of 14 January 1862 but subject to repayment of 1700 and interest at 5% p.a. and also to right of iii) under agreement of 1 October 1862 copy sigs of i), ii) and iii) 4 December 1862 'Presuming all the recitals and all the facts stated to be correct I approve of this Draft Thos Sworder Hereford
